R-90-� A RESOLUTION AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE A SETTLEMENT AGREEMENT WITH NANCY STRICKLAND AND THE FEDERATION OF PUBLIC EMPLOYEES (FPE) REGARDING BINDING ARBITRATION CONCERNING SEPARATION OF EMPLOYMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the appropriate City officials are hereby authorized to execute a Settlement Agreement with Nancy Strickland and Federation of Public Employees (FPE) regarding binding arbitra- tion concerning separation of employment, a copy of said agreement being attached hereto as "Exhibit 1". WHEREAS, the City of Tamarac separated Nancy Strickland from her employment as of July 15, 1989; and WBERRAS, the Federation of Public Employees and Nancy Strickland have requested binding arbitration regarding said separation; and WHEREAS, Nancy Strickland, the Federation of Public Employees and the City of Tamarac all wish to forego and to hereby waive binding arbitration of said separation of employment without any admission of guilt or liability of any party; NOW, THEREFORE, in consideration of the mutual covenants contained herein, the City of Tamarac, the Federation of Public Employees and Nancy Strickland do hereby stipulate and agree as follows: 1. That all of the above is hereby true and correct to the best of the parties' knowledge and belief. 2. That the City of Tamarac shall offer and Nancy Strickland shall accept a position as Records Clerk/Buildings Department at an annual salary of Fifteen Thousand Six Hundred Dollars ($15,600.00) commencing on January 29, 1990. 3. That the City of Tamarac shall rescind and remove from Nancy Strickland's Personnel file its July 19, 1989 Separation of Employment letter and shall treat the period from July 15, 1989 through January 28, 1990 as a period during which Nancy Strickland was on layoff status with all rights accruing pursuant to that layoff status. By way of clarification, Nancy Strickland's date of hire, as well as her seniority date, shall remain February 8, 1982. Nancy Strickland shall be entitled to all benefits accruing from that seniority date, February 8, 1982, including but not limited to, layoffs, promotions, vacation bids. Further, all benefits shall be restored including but not limited to unused sick leave, vacation leave, etc. In sum, Strickland shall not be prejudiced with regard to any rights as a result of her being on layoff status during this period. 4. The City of Tamarac shall pay to Nancy Strickland the sum Of Three Thousand Five Hundred Dollars ($3,500.00) as lump sum settlement of any and/or all disputed claims arising from her layoff in July, 1989. 5. As soon as possible, the City of Tamarac and the Federation shall select a mutually agreeable neurologist to physically examine Nancy Strickland in order to determine her physical ability to perform the job of Records Clerk/Building Department. In the event that the parties are unable to secure an e_�o-3 I C examination prior to Nancy Strickland's recommencement of employ- ment, January 29, 1990, Nancy Strickland shall commence her employment on January 29, 1990 subject to the neurologist's report stating that she is physically able to perform her job. 6. The Federation shall withdraw Nancy Strickland's grievance arising out of her July, 1989 separation of employment.
