R--90-- �-S A RESOLUTION RECOGNIZING METRO-BROWARD PROFESSIONAL FIRE FIGHTERS, LOCAL 3080, INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS (TAFF), AS THE EXCLUSIVE BARGAINING REPRESENTATIVE OF THE CITY'S FIRE INSPECTORS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Metro-Broward Professional Fire Fighters, Local 3080, International Association of Fire Fighters (TAFF), has requested recognition as the exclusive collective bargaining representative of the fire inspectors employed by the City's Fire Department; and WHEREAS, Local 3080 has presented to the City authorization cards verifying that Local 3080 has been so selected and authorized by said fire inspectors. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Metro--Broward Professional Fire Fighters, Local 3080, International. Association of Fire Fighters (TAFF), is recognized as the exclusive bargaining representative of the fire inspectors employed by the City of Tamarac Fire Department. SECTION 2: That the City Manager is hereby authorized to sign the Recognition -Acknowledgement Petition submitted by Local 3080 on behalf of the City of Tamarac. RESPONDENTS ANSWER TO REPRESENTATION -CERTIFICATION PETITION COMES NOW the Respondent, CITY OF TAMARAC, by and through its undersigned counsel, and as and for its answer to the Representation -Certification Petition which was filed herein by Petitioner, METRO-BROWARD PROFESSIONAL FIRE FIGHTERS, LOCAL 3080, IAFF, says as follows: 1. That Respondent has no objection to the inclusion of 0 the present fire inspector in the unit. The present fire inspector is David Viele. 2. That Respondent objects to the inclusion of the fire captain in the proposed unit. The acting captain is Dennis Peloso; however, Dennis Peloso has requested that he be returned to the rank of lieutenant and, therefore, after January 1, 1990, the position of fire captain will be vacant. 3. That the Respondent objects to the inclusion of the fire captain in the unit on the grounds that, in the present structure of the Tamarac Fire Department, the fire captain is a manager and is a confidential employee within the meaning of Florida Statutes. • 4. Specifically, the fire captain participates as management in collective bargaining and in preparation of budgets in anticipation of collective bargaining. Further, since there is no assistant chief, the fire captain has been acting as the assistant fire chief.
