3 RESOLUTION NO. R-90--
A RESOLUTION AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO EXECUTE AN AGREEMENT
WITH SOUTHLAND CONTROLS, INCORPORATED,
RELATING TO THE PURCHASE OF A WALLACE AND
TIERNAN GRIT COLLECTOR ASSEMBLY; AND
PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
y SECTION 1: That the appropriate City officials are hereby
1D authorized to execute an Agreement with Southland Controls,
Incorporated, relating to the purchase of a Wallace and Tiernan
12 Grit Collector Assembly in the amount of $6,432.08, a copy of said
13 agreement being attached hereto as "Exhibit 1".

SECTION 2: This Resolution shall become effective
upon its adoption.

CITY OF TAMARAC
AND
SOUTHLAND CONTROLS INCORPORATED
RELATING TO THE PURCHASE OF A
WALLACE AND TIERNAN GRIT COLLECTOR ASSEMBLY
This is an Agreement between the City of Tamarac, a
Florida Municipal Corporation ("City"), and "Southland
Controls Incorporated", a Florida Corporation and authorized
Agent of Wallace and Tiernan, its successors and assigns
(Southland):
W I T N E S S E T H:
WHEREAS, the City of Tamarac has determined that it must
purchase a new Wallace and Tiernan Grit Remover Assembly
U25863 to replace a worn out and attrited item on the main
water treatment slaker unit; and
WHEREAS, the required Wallace and Tiernan Grit Remover
Assembly U25863 must be a direct replacement of the existing
installed unit, used by the main treatment device, to insure
absolute compatibility; and
WHEREAS, Section 6-151(3) of the City of Tamarac Code of
Ordinances requires that sole source purchases in an amount
over two thousand dollars ($2,000.00) be the subject of a
formal written contract approved by the City Council.
NOW, THEREFORE, IN CONSIDERATION of the mutual terms and
conditions, promises, covenants and payment hereinafter set
forth, "City" and "Southland Controls Incorporated", agree as
follows:
1. The above recitals are incorporated herein and are
male a part of this Agreement.
2. "Southland Controls Incorporated" agrees to provide
and the "City" agrees to purchase: one (1) Wallace
and Tiernan Grit Remover Assembly U25863 direct
replacement unit applicable with constituents and
appurtenances in the amount of six thousand four
hundred thirty two dollars and eight cents
($6,432.08).

3. The "City" and "Southland Controls Incorporated" agree
that the above quoted price shall include delivery of
the aforementioned unit.
4. The "City" and "Southland Controls Incorporated" agree
that prompt delivery of this Wallace and Tiernan Grit
Remover Assembly U25863 will be attempted in every
possible manner so as to hasten receipt of this unit
by the Utility Department.
IN WITNESS whereof, the parties hereto have made and
executed this Agreement on the respective dates under each
signature. The City of Tamarac signing by and through its
Mayor, authorized to exe ute same by City Cou cil action on
the __ day of 19 and
Wallace & Tiernan, Incorporated, signing by and through its
Representative duly authorized to execute same.
