RESOLUTION NO. R-90-- _4_1_
A RESOLUTION AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE AN AGREEMENT WITH LENNAR
HOMES, INC., PERTAINING TO ALTERNATIVE DRAIN-
AGE FOR THE EXETER PLAT; AND PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the appropriate City officials are
hereby authorized to execute an Agreement with Lennar Homes,
Inc., pertaining to alternative drainage for the Exeter project,
a copy of said agreement being attached hereto as "Exhibit 1".
SECTION 2: That the City Clerk is hereby authorized and
directed to record said agreement in the public records of
Broward County, Florida.
SECTION 3: This Resolution shall become effective upon
adoption.

AGREEMENT FOR ALTERNATIVE DRAINAGE
THIS AGREEMENT is made by and between LENNAR HOMES, INC., a Florida
corporation, ("Developer"), and the City of Tamarac, a municipal subdivision
of the State o' ''lorida ("City").
W I T N E S S E T H:
WHEREAS, the l veloper is the fee simple owner of certain real property
located in the City, as more particularly described in Exhibit 1 attached
hereto and made a part hereof ("Property"); and
WHEREAS, the Developer is in the process of platting the Property which
plat shall be known as the Exeter Plat; and
WHEREAS, the City is the fee simple owner of certain canals which are
located as shown and as more particularly described in Exhibit 2 attached
hereto and made a part hereof ("Canal A"), and Exhibit 3 attached hereto and
made a part hereof ("Canal B"); and
WHEREAS, the City is the grantee of certain easements to service Canals A
and B, as more particularly described in Exhibit 4 attached hereto and made a
part hereof ("Easement A"), and Exhibit 5, which is attached and made a part
hereof ("Easement B");
WHEREAS, Canals A and B are presently utilized as part of an existing
drainage system to service the Property and surrounding areas ("Existing
Drainage");
WHEREAS, the Developer intends to construct alternative drainage on the
Property ("Alternative Drainage") which would eliminate the need for Canals A
and B and Easements A and B and accordingly, Developer desires that the City
convey title to Canals A and B to the Developer and that the City vacate and
extinguish Easements A and B; and;
WHEREAS, the City has no objection to this proposed Alternative Drainage
system subject to the terms and conditions contained herein;
NOW, THEREFORE, in consideration of the mutual covenants and representa-
tions contained herein and the conveyance of Canals A and B to the Developer
and the termination of Easements A and B, the parties agree as follows:
1. The above recitals are true and correct and are incorporated herein.
2. The City does hereby remise, release and quitclaim to the Developer
all right, title, equity, claim, demand and interest which the City has in
Canals A and B by quit claim deed, a copy of which is attached hereto and made
a part hereof as Exhibit 6; and the City does hereby vacate, terminate,
extinguish and release Easements A and B and any rights, claims, demands and
interest contained therein by written instrument entitled "Termination of
Easements", a copy of which is attached hereto and made a part hereof as
Exhibit 7.
3. The Developer shall design and construct Alternative Drainage in
accordance with plans approved by the City and in compliance with all required
permits. The Developer shall not fill, alter, impede, interfere with nor cut
off the Existing Drainage until the City Engineering Department has approved
and accepted the Alternative Drainage. Within five (5) business days of the
acceptance of Alternative Drainage, the City Engineer shall execute and
deliver to Developer a document in recordable form attesting to such
acceptance.
4. The Developer shall secure its obligations contained herein by a
letter of credit, a copy of which is attached hereto and made a part hereof as
Exhibit 8.
5. Within thirty (30) business days of the acceptance of the Alternative
Drainage system, or the reconveyance of the Property to the City in accordance
with the provisions of the quit claim deed, the City shall release and return
to Developer the letter of credit described in Paragraph 4.

6. This agreement shall be binding upon the Developer and the City and
their respective successors and assigns.
7. Until further written notice by either party to the other, all
notices pertaining to this agreement shall be in writing and transmitted by
messenger or certified mail, return receipt requested and mailed or delivered
as follows:

8. This agreement shall be governed by the laws of the State of
Florida. In the event either party to this agreement is required to enforce
the terms of this agreement by court proceedings or otherwise, the prevailing
party shall by entitled to recover from the other party all costs incurred,
including reasonable attorney's fees at both the trial and appellate levels.
9. In connection with the recordation of the quit claim deed and the
termination of easement documents in the Public Records of Broward County,
Florida, the Developer shall pay for any recording coats and any Florida
documentary stamps.
10. This agreement supersedes all previous agreements or representations,
either oral or written, and when duly executed constitutes the entire •
agreement between the parties. The effective date of this agreement shall be
the date the last party executes this agreement.
