R-90-- A RESOLUTION AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE A TERMINATION OF EASEMENTS WITH LENNAR HOMES, INC., PERTAINING TO VACATING CERTAIN CANAL MAINTENANCE EASEMENTS FOR THE EXETER PLAT; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the appropriate City officials are hereby authorized to execute a Termination of Easements with Lennar Houses, Inc., pertaining to vacating certain canal maintenance easements for the Exeter project, a copy of said document being attached hereto as "Exhibit 1". SECTION 2: That the City Clerk is hereby authorized and directed to record said document in the public records of Broward County, Florida. WITNESSETH: WHEREAS, the City is the grantee of certain easements recorded in the Public Records of Broward County, Florida, at Official Records Book 9768, Page 886, Official Records Book 9768, Page 896, and Official Records Book 9768, Page 912, all as more particularly described in Exhibit "A" attached hereto and made a part hereof; and WHEREAS, the grantor's successor in interest, Lennar Homes, Inc., desires the termination of the above described easements; and WHEREAS, the City has no objection to the release of these easements. NOW, THEREFORE, in consideration of the premises and the sum of Ten Dollars ($10.00), the receipt of which is hereby acknowledged, the City hereby remises, releases, vacates, terminates and extinguishes the easements shown in Exhibit "A" and any rights, claims, demands and interest contained therein.
