CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R--90- Z(o
A RESOLUTION DECLARING A WATER AND SEWER
DEVELOPER'S AGREEMENT WITH W.H.K. PARTNERSHIP, FOR
DESIGN PLAZA WEST, LOCATED AT THE SOUTHEAST CORNER
OF 94 AVENUE AND NORTHWEST 58 STREET (LOTS l AND 2
LYONS INDUSTRIAL PARK), IN DEFAULT; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City entered into a Water and Sewer Developer's
Agreement with W.H.K. Partnership predecessor in title to the
property known as Design Plaza West, located at the Southeast
corner of 94 Avenue and Northwest. 58 Street (Lots 1 and 2 Lyons
Industrial Park), which agreement. dated September 28, 1988, was
recorded in Q.R. Book 5912, Page 192, of the public records of
Broward County, Florida; and
WHEREAS, the Agreement provides that it shall be binding upon
the developer, its successors and assigns; and
WHEREAS, W.H.K. Partnership has tailed to pay the Guaranteed
Revenues, as required by this Agreement, from March, 1989 though
December, 1989, for a total of $391.40; and
WHEREAS, the City Council wishes to declare this Agreement in
default.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the Water and Sewer Developer's Agreement
dated September 28, 1988 and recorded in O.R. Book 5912, Page 192,
of the public records of Broward County, Florida, between the City
and W.H.K. Partnership is hereby declared in default due to
failure to pay Guaranteed Revenues from March, 1989 through
December, 1989, in a total amount of $391.40.
SECTION 2: That the City Clerk is hereby directed to record
this Resolution in the public records of Broward County, Florida.
SECTION 3: That the City Clerk is hereby directed to transmit
a certified copy of this Resolution to W.H.K. Partnership.

SECTION 4: This Resolution shall become effective immediately
upon adoption.
