R-85-� 3 4 A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 147 FOR A REVISED SITE PLAN FOR MAINLANDS 13 (SUNSET 5 ISLE); AND PROVIDING AN EFFECTIVE DATE. 6 7 WHEREAS, pursuant to the instructions of the City Council of 8 Tamarac, Florida, a public meeting has been advertised in accordance 9 with applicable law of the date, time and place of the meeting regard 10 ing the review of the application for a development order by the 11 applicant for development approval; and 12 WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations; and the 13 14 attached Development Review Status Sheet dated 1/3/85; and 15 WHEREAS, the City Council reviewed the development order and 16 accompanying documents at a public meeting; and 17 WHEREAS, the City Council has determined that the application is 1$ in compliance with all elements of the Comprehensive Plan, or will be 19 in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. 20 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, 21 FLORIDA: 22 SECTION 1: That the application for approval of a revised site 23 plan for Mainlands 13 (Sunset Isle), revised December 19, 1984, to 24 reflect a conversion of the barbeque pit to a storage room, is 25 approved subject to the following conditions: 26 A. Construction is to be in complete compliance with the plans 27 and specifications submitted by the developer to the City of Tamarac 28 as described in Section II of the Development Review Status Sheet. 29 B. Commencement of construction shall be no longer than one .30 year from the date of this approval. If the development does not 31 commence construction within one year, this approval is null and void 32 unless an extension has been granted in accordance with applicable 33 regulations. 34 00 Temp. #3466 1 2 3 M 5 6 7 10 11 12 13 14 15 16 17 18 19 20 71 22 23 24 25 26 27 28 29 30 31 32 33 34 C. The development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the development order are set forth as follows: 1. If applicant wishes to include a walkway to- the building, it should be included on the site plan. 2. Landscaping is to be placed around the base of the building. SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This development order as conditioned shall become effective immediately upon its passage. PASSED, ADOPTED AND APPROVED this day of , 1985.
