A RESOLUTION ISSUING REVISED DEVELOPMENT
3 ORDER NO. 140-2 FOR A REVISED SITE PLAN
FOR LAKE COLONY (BROOKWOOD GARDENS); AND
4 PROVIDING AN EFFECTIVE DATE.
5 WHEREAS, pursuant to the instructions of the City Council'of
Tamarac, Florida, a public meeting has been advertised in accordance
with applicable law of the date, time and place of the meeting re-
8 garding the review of the application for a revised development
g order by the applicant for development approval; and
10 WHEREAS, the City Council has examined and investigated the
11 application and staff recommendations; and the attached Development
12 Review Status Sheet dated 4/3/85; and
13 WHEREAS, the City Council reviewed the revised development
order and accompanying documents at a public meeting; and
15 WHEREAS, the City Council has determined that the application
16 is in compliance with all elements of the Comprehensive Plan, or will
17 be in compliance prior to the issuance of a Certificate of Occupancy
18 for the development that is the subject of the application.
19 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
a.4:? FLORIDA:
21 SECTION 1: That the application for approval of a revised site
22 plan for Lake Colony (Brookwood Gardens), prepared by Lawrence D.
23 Kramer, Architect, revised March 26 and April 3, 1985, to reflect
24 revised canal slopes, a six-foot fence along the north property -line
25 and update of overall site plan, is approved subject to the following
conditions:
27 A. Construction is to be in complete compliance with the plans
28 and specifications submitted by the developer to the City of Tamarac
29 as described in Section II of the Development Review Status Sheet and
approved engineering drawings.
B. Commencement of construction shall be no longer than one
32 year from the date of this approval. If the development does not
33 commence construction within one year, this approval is null and
34 void unless an extension has been granted in accordance with
applicable regulations.

C. The revised development order is assignable, but an
assignment does not discharge any assignee from strict compliance
with the order unless the City Council consents to modify any of thel
original requirements.
D. Additional conditions established in order to issue the
revised development order are set forth as follows:
1 - The applicant to provide note on the site plan stating:
No heavy landscaping or berms within 7-1/2 feet of public
water or sewer lines and remove the existing bench located
over the water line per City Engineer's request OR provide
a covenant acceptable to the City Attorney and City Engine
relative to future responsibility for removing said items
if utility work requires their removal.
2 - Applicant to submit revised as-builts satisfactorily
indicating to the City Engineer that all buildings are not
in conflict with installed utility and drainage lines or
the applicant shall not receive subsequent building permits
on units 42, 43, 110, 125, 132, 133 and 154 until this
matter is corrected.
SECTION 2: Should any section or provision of this re-
vised development order be declared by a court of competent juris-
diction to be invalid, the City Council shall determine if the other
portions of the order remain valid or whether the approval shall
be null and void.
SECTION 3: This revised development order as conditioned
shall become effective immediately upon -its passage.

Project subject to the requirements included in the Report and the following
conditions:
Staff had requested the applicant update the drawings to reflect all
previously approved revisions. The attached drawing, prepared by
the architect, reflects these previously approved revisions as well
as the following items:
a) canal slopes
b) 6' fence along north property line
STAFF recommends Council approval of the revised site plan conditioned
upon the following:
The applicant to provide note on the site plan stating:
