CITY OF TAMARAC, FLORIDA
RESOLUTION NO: R--cP5_/v
A RESOLUTION REPEALING RESOLUTION NO. R-84-
406 REGARDING RELEASE AND ASSIGNMENT OF
TAMARAC'S WASTEWATER PLANT CAPACITY AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Tamarac and Broward County are still negotiating
the details of the assignment of Tamarac's Excess Plant Capacity.at the County's
Northwest Regional Wastewater Treatment Plant; and
WHEREAS, the provisions of the assignment Agreements
authorized by Resolution R-84-406 need to be revised to resolve the issue of
late fees and time and method of payment; and
WHEREAS, the City Council wishes to withdraw its release
and assignment Agreements briefly so that they can be revised to meet the
requirements of Broward County and Tamarac.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
SECTION l: That Resolution R-84--406 is hereby repealed.
SECTION 2: That Linton Lovett, Esquire, and the City
Attorney are authorized to continue negotiations to finalize the release and
assignment of Tamarac's Excess Wastewater Plant Capacity at Broward County's
Northwest Regional Wastewater Disposal Plant.
SECTION 3: This Resolution becomes effective immediately
upon passage.
