3 A RESOLUTION ISSUING REVISED DEVELOPMENT
ORDER NO. 091-3 FOR A REVISED SITE PLAN
4 FOR TAMARAC MARKET PLACE; AND PROVIDING
AN EFFECTIVE DATE.

WHEREAS, pursuant to the instructions of the City Council
of Tamarac, Florida, a public meeting has been advertised .in
8 accordance with applicable law of the date, time and place of
9 the meeting regarding the review of the application for a
10 revised development order by the applicant for development
11 approval; and
12 WHEREAS, the City Council has examined and investigated the
13 application, staff and Planning Commission recommendations; and
the attached Development Review Status Sheet dated 4/17/85; and
15 WHEREAS, the City Council has reviewed the revised develop-
16 ment order and accompanying documents at a public meeting; and
17 WHEREAS, the City Council has determined that the applica-
18 tion is in compliance with all elements of the Comprehensive Plan
19 or will be in compliance prior to the issuance of a Certificate
of Occupancy for the development that is the subject of the
21 application.

22 NOW, THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
23 TAMARAC, FLORIDA:
24 SECTION 1: That the application for approval of a revised
25 site plan for Tamarac Market Place, prepared by Randall F. Keller,
AIA, PA, revised March 27, 1985, to reflect a kiosk building for
27 National Insurance Company of America, is approved subject to the
28 following conditions:
29 A. Construction is to be in complete compliance with the
30 plans and specifications submitted by the developer to the City
21 of Tamarac as described in Section II of the Development Review
32 Status Sheet and approved engineering drawings.
33 B. Commencement of'construction shall be no longer than one
34 year from the date of this approval. If the development does
not commence construction within one year, this approval is

null and void unless an Qxtension has been granted in accordance
with applicable regulations.
C. The revised development order is assignable, but an
assignment does not discharge any assignee from strict compliance
with the order unless the City Council consents to modify any of
the original requirements.
D. Additional conditions established in order to issue,the
revised development order are set forth as follows:
1 - Dimensions are to be placed on plan showing distance
from property lines and adjacent buildings.
2 - The material_ and colors of this kiosk building most
be compatible or the same as the main adjacent strtic-
ture.
SECTION 2: Should any section or provision of this revised de-
velopment order be declared by a court of competent jurisdiction to
be invalid, the City Council shall determine if the other portions c
the order remain valid or whether the approval shall be null and vol
SECTION 3: This revised development order as conditioned shall
become effective immediately upon its passage.
