A RESOLUTION AUTHORIZING THE GRANT OF A NON-
EXCLUSIVE TELEPHONE EASEMENT TO SOUTHERN BELL
TELEPHONE & TELEGRAPH COMPANY AT TAMARAC PARK;
PROVIDING FOR SEVERABILITY OF INVALID PROVI-

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
5FC,TION 11: That the City Council of the City of Tamarac
hereby authorizes the grant of a non --exclusive telephone
easement to Southern Bell Telephone & Telegraph Company at
Tamarac Park (attached as Exhibit "A").
SECTION.._ 2., That the proper city officials are hereby
directed and authorized to execute said easement.
EF,TIQN —3.: Should any section or provision of this
Resolution or any portion thereof, or any paragraph, sentence
or word be declared by a Court of competent jurisdiction to
be invalid, such decision shall not affect the validity of
the remainder hereof as whole or any part hereof, other than
the part declared to be invalid.
SZ-03-0-4.: This Resolution shall become effective
immediately upon passage.

TELEPHONE EASEMENT
' This Telephone Easement made this 7112wday of ,
1985, by The City of Tamarac, a Florida municipal corporation,
having an address at 5811 Northwest 88th Alrenue, Tamarac,
Florida 33321, (Grantor), and Southern Sell Telephone & Telegraph
Company, 2000 North State Road '/, Margate, rlvr;da -30r.3
(Grantee).
(Whenever used herein, the term "Grantor" and "Grantee" shall
include the respective successors and assigns of the parties
hereto, whenever the context so admits or require).
WITNESSETH:
WHEREAS, Grantor is the owner of that certain real property located in
Broward County, more particularly described in Exhibit "A" attached hereto,
(hereinafter referred to as "Servient Estate") and
WHEREAS, Grantor desires to grant unto Grantee a non-exclusive easement
to use a portion of the servient estate;
WOW, THEREFORE, in consideration of the sum of TEN DOLLARS ($10.00) and
athe.r good and valuable considerations paid by each of the parties hereto to
the other party, receipt of which is hereby acknowledged by both parties, the
parties hereto do hereby grant and agree as follows:
1. Grantor hereby grants and conveys to Grantee, its successors
and assigns, a non-exclusive easement over and upon the servient estate for
the installation and maintenance of public utilities.
2. Grantor reserves all rights not herein granted pursuant to
this easement& including but not limited to, the right of free ingress and
egress over and upon the servient estate and to grant further easements
under, over and on the servient estate; provided that, in ao event shall any
of the rights herein reserved impede the easement herein granted or the
exercise of the rights of use thereunder.
3. The provisions of this easement shall be binding on the
parties hereto and the respective successors and assigns as a covenant

COMMENCING at the Southeast corner of said Section 4;
THENCE North 1038132" West along the East line of said
Section 4, a distance of 2,396.14 feet;
THENCE South 88°21'28" West, a distance of 60 feet to
the point of beginning;
THENCE North 8907140" West, a distance of 382.21 feet;
THENCE North 1038'32" West 10.0 feet;
THENCE South 8907140" East, a distance of 382.21 feet;
THENCE South 1038132" East, along a line parallel with and
60 feet West of the East line of Said Section 4 and
the center line of University Drive, a distance of
10 Feet to the point of beginning.
This easement is a portion of the easement dedicated to Florida
Power & Light as recorded in Plat Book 7454, Page 860 and 861.
