R-85- l f3 A RESOLUTION APPROVING AND ACCEPTING AN ON -SITE BLANKET INGRESS/EGRESS EASEMENT OFFERED BY SUNMARK HOMES, INC., FOR THE JASMINE PROJECT; AND PROVIDING AN EFFEC- TIVE DATE. BE IT RESOLVED, BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the on -site blanket ingress/egress easement offered by Sunmark Homes, Inc., for the Jasmine Project, is hereby approved and accepted, a copy of said easement being attached hereto as Exhibit A. SECTION 2: That the City Clerk is hereby authorized and directed to record said easement in the public records of Broward County, Florida. SECTION 3: This Resolution shall become effective upon adoption. PASSED, ADOPTED AND APPROVED this day of ,1985. BLANKET INGRESS AND EGRESS EASEMENT This Indenture, made this day of =Q't. r 1985, between the undersigned Grantor, being the owner of the property herein described, and the City of Tamarac, a municipal corporation, existing under the laws of the State of Florida, whose mailing address is 5811 Northwest 88th Avenue, Tamarac, Florida, 33321, hereinafter referred to as Grantee. W I T N E S S E T H: Grantor for and in consideration of the sum of TEN ($10.00) DOLLARS and other good and valuable considerations to it in hand paid by Grantee, the receipt of which is hereby acknowledged, does hereby grant and convey to Grantee, its successors and assigns, a non-exclusive blanket easement for ingress and egress purposes upon, over and across the described land lying and being in Broward County, Florida, described in Exhibit "A". This Blanket Ingress and Egress Easement is granted to Grantee for the specific purpose of access by Grantee, for Grantee to provide municipal services to the above -described property such as utility services, fire protection, police protection, and emergency and other public safety services. It is acknowledged that Grantor, or its successors, intends to construct residential dwellings and other improvements upon the above -described property, and nothing contained herein shall be deemed to prohibit or restrict Grantor or its successors from constructing any buildings or improvements upon the property, subject to the requirements of Grantee or any other controlling governmental authority, and upon the construction of any buildings and improvements upon the property the easement created hereby shall be subject to such improvements as are constructed and shall be used by Grantee in a manner which is consistent with the buildings and improvements constructed upon the property and which, to the extent possible, will minimize interference with and will be compatible with the construction and use of said buildings and improvements.
