R-85- 205 3 A RESOLUTION APPROVING STIPULATION 19 TO 4 CASE NO. 72--11731-CZ WITH WOODMONT CENTER ASSOCIATES; AUTHORIZING THE APPROPRIATE 5 CITY OFFICIALS TO EXECUTE SAME; AND PROVIDING AN EFFECTIVE DATE. 6 7 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: g SECTION 1: That Stipulation 19 to Case No. 72-11731-CZ 9 with Woodmont Center Associates, successor in interest to Leader- 10 ship Housing Systems, Inc., and Simon Zunamon, as Trustee, for 11 Lots 5, 6, 7 and 8 of Block 35, McNab Commercial Subdivision No. 2, 1.2 is HEREBY APPROVED AND ACCEPTED, a copy of said Stipulation being 13 attached hereto as Exhibit "A". 14 SECTION 2: That the appropriate City officials are hereby 15 authorized to execute this Stipulation on behalf of the City. IN THE CIRCUIT COURT OF THE 17TH JUDICIAL CIRCUIT IN AND FOR BROWARD COUNTY, FLORIDA CASE NO. 72-11731-CZ (Weissing) STIPULATION 19 COMES NOW, doing business as WOODMONT CENTER ASSOCIATES, a general part- nership as Owner and Developer herein after referred to as Woodmont Center Associates, with a principal business address of by and through its undersigned counsel, as directed and approved by the City Council of the City of Tamarac, by Motion at their 1985 meeting, and file this their Stipulation and state as follows: 1. That Woodmont Center Associates is the owner and developer of a parcel of land which lies within Land Sections 40 5 and 6 in the City of Tamarac, and therefore as successor to the Plaintiff is a proper party to this Stipulation. 2. The zoning of the property is presently in dispute. Woodmont Center Associates is petitioning the City for a reaoning to B-1 zoning asdefined in the Tamarac City Code. A concept Site Plan has already been approved by the Planning Commission and City Council and the development of the parcel shall be substantially consistent with the concept Site Plan which is attached hereto as Exhibit "A". A final site plan for the prop- erty will be processed simultaneously with the rezoning. 3. The legal description of the property which is the subject of this Stipulation is: LOTS 5, 6, 7, and 8 of BLOCK 35, MCNAB COMMERCIAL SUBDIVISION N0. 2, according to the plat thereof, as recorded in Plat Book 73, Page 28 of the Public Records of Broward County, Florida.
