CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-85--223
A RESOLUTION AWARDING A BID FOR UTILITIES WEST
WELLS 12 AND 13 BID #85-23; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Council authorized the administration to go to
bid at its meeting of May 22, 1985; and
WHEREAS, bids were advertised in the Fort Lauderdale News, a
newspaper of general circulation in Broward County, on June 3 and June 10, 1985;
and
WHEREAS, bids were opened on June 24, 1985; and
WHEREAS, R.J. Sullivan Corp. is the lowest fully responsive and
responsible bidder to perform the work listed in Section 1 below; and
WHEREAS, K. Herron & Sons Concrete Construction Co., Inc., is the
lowest fully responsive and responsible bidder to perform the work listed in
Section 2 below.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TAMARAC, FLORIDA:
SECTION 1: That the bid of R.J. Sullivan Corp. in the amount of
$168,800.00, is hereby approved for the construction of Wells No. 12 and 13 (Bid
Item #1 ), with funds to come from CIAO Account 432-363-537-645.
SECTION 2: That the bid of K. Herron & Sons Concrete Construction
Co., Inc., in the amount of $15,750.00, is hereby approved for the construction
of sidewalks (Bid Item
#2), with funds
from
CIAC Account 432-363-537-645.
SECTION
3: This Resolution

become effective immediately upon
adoption.

1. The undersigned BIDDER proposes and agrees, if this Bid is _accepted, to
enter into an Agreement with OWNER in the form included in the Contract
Documents to complete all Work as specified or indicated in the Contract
Documents for the Contract Price and within the Contract Time indicated in
this Liu and in accordance with the Contract Document.
2. BIDDER accepts all of the terms and conditions of the Instructions to
Bidders, including without limitation those dealing with the disposition
of Bid Security. This Bid will remain open for sixty days after the day
of Bid opening. BIDDER will sign the Agreement and submit the Contract
Security and other documents required by the Contract Documents within
fifteen days after the date of OWNER's Notice of Award.
3. In submitting this Bid, BIDDER represents, as more fully set forth in the
Agreement, that:
a. BIDDER has examined copies of all .the Contract Documents and of the
following addenda:

progress or performance of the Work and has made such independent
investigations as BIDDER deems necessary.
c. This Bid is genuine and not made in the interest of or on behalf of
any undisclosed person, firm or corporation and is not submitted in
conformity with any agreement or rules of any group, association,
organisation or corporation; BIDDER has not directly or indirectly
induced or solicited any other Bidder to submit a false or sham Bid;
BIDDER has not solicited or induced any person, firm or a corporation
to refrain from bidding; and BIDDER has not sought by collusion to
obtain for himself any advantage over any other Bidder or over OWNER.

In the event that additions to, or deductions f rom, the work shown on the
Plans or described in the Specifications are made, the bidder agrees that
the following unit prices shall be used in making additions to, or
deductions from, the Contract Documents.
a. Add or deduct for Well Casing Length /QO. 00 per linear foot
over or under 100 feet
b. Add or deduct for Pump Column Length # &0,00 per 10 foot length
5. BIDDER agrees that the Work will be substantially completed within 180
calendar days after the date when the Contract Time commences to run, and
completed within 210 calendar days after the date' when the Contract Time
commences to run.
BIDDER accepts the provisions of the Agreement as to liquidated damages in
the event of failure to complete the Work on time.
6. The undersigned agrees as follows:
Accompanying this Proposal is a cashier's check or bid bond (52 of Total
Bid Price) forpayable to the City of Tamarac which is
to be forfeited if, in the event that this Proposal is accepted, the
undersigned shall fail to execute the contract and furnish satisfactory
Contract Security under the conditions and within the time specified in
the Instructions to Bidders; otherwise, said cashier's check or bid bond
is to be returned as provided herein.
