A RESOLUTION ISSUING DEVELOPMENT ORDER
NO. 147 FOR A REVISED SITE PLAN FOR,UN.IVERSITY

TEXACO; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, pursuant to the instructions of the City Council of
Tamarac, Florida, a meeting has been in
public advertised accord-
7
ance with applicable law of the date, time and place of the meet-
8
ing regarding the review of the application for a development
9
order by the applicant for development approval; and
10
WHEREAS, the City Council has examined and investigated the
11
application and staff recommendations; and the attached Develop-
12
ment Review Status Sheet dated 1.2/19/84; and
13
WHEREAS, the City Council reviewed the development order and
14
accompanying documents at a public meeting; and
15
WHEREASi the City Council has determined that the application
16
is in compliance with all elements of the Comprehensive Plan, or
17
will be in compliance prior to the issuance of a Certificate of
is
Occupancy for a development that is the subject of the application.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
20
TAMARAC, FLORID.A:

SECTION 1: That the application for approval of a revised
22
site plan for University Texaco, prepared by Donald Wayne Shuey &
23
Associates, revised June 15, 1984, to reflect a catch basin and a
24
trench drain, is approved subject to the following conditions:

A. Construction is to be in complete compliance with the
26
plans and specifications submitted by the developer to the City of
27
Tamarac as described in Section II of the Development Review
28
Status Sheet and approved engineering drawings.
29
B. Commencement of construction shall be no longer than one
30
year from the date of this approval. If the development does not
31
commence construction within one year, this approval is null and
32
void unless an extension has been granted in accordance with
33
applicable regulations.

C. The development order is assignable, but an assignment
does not discharge any assignee from strict compliance with the
order unless the City Council consents to modify any of the
original requirements.
D. Additional conditions established in order to issue the
development order are set forth as follows:
1 - No permits will be issued until a signed sidewalk
easement on McNab Road is submitted to the City.
SECTION 2: Should any section or provision of this develop-
ment order be declared by a court of competent jurisdiction to
be invalid, the City Council shall determine if the other portions
of the order remain valiA or whether the approval shall be null
and void.
SECTION 3: This development order as conditioned shall
become effective immediately upon its passage.
