A RESOLUTION APPROVING AND ACCEPTING A
RIGHT-OF-WAY DEED FOR 40-FEET ALONG LOTS
15 AND 16, BLOCK 11, LYONS COMMERCIAL SUB-
DIVISION #3, ALONG UNIVERSITY DRIVE OFFERED
BY UNIVERSITY DRIVE PARTNERSHIP; AND PRO-
VIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COUNCIL OF TAMARAC, FLORIDA:
SECTION 1: That the right-of-way deed'for 40-feet along
Lots 15 and 16, Block 11, Lyons Commercial Subdivision #3, along
University Drive offered by University Drive Partnership, is HEREBY
APPROVED and accepted, a copy of said deed being attached hereto
as Exhibit A.
SECTION 2: That the City Clerk is hereby authorized
and directed to record said deed in the public records of Broward
County.
SECTION 3: This Resolution shall become effective
immediately upon adoption.

TO THE CITY OF TAMARAC

COUNTY OF BROWARD ) SS:
THIS INDENTURE, made this llth day of July, 1985, by and
between UNIVERSITY DRIVE PARTNERSHIP, a Florida general partner-
ship, whose address is 540 Northeast Fourth Street, Fort
Lauderdale, Florida 33301, party of the first part, and the CITY
OF TAMARAC, a Municipal corporation of the State of Florida, and
its successors in interest, whose principal place of business is
5811 Northwest 88th Avenue, Tamarac, Broward County, Florida
33321, party of the second part.
W I T N E S S E T H:
That the said party of the first part, for and in considera-
tion of the sum of One Dollar ($1.00) to it in hand paid by the
party of the second part, receipt whereof is hereby acknowledged,
and for other and further good and valuable considerations, does
hereby grant, bargain and sell to the party of the second part,
and its successors in interest, for the purpose of a public road
right-of-way and purposes incidental thereto, the following
described land, situate, lying and being in the County of Broward,
State of Florida, to wit:
The Westerly 40 feet of Lots 15 and 16 in Block 11, of
LYON'S COMMERCIAL SUBDIVISION NO. 3, according to the
plat thereof, recorded in Plat Book 76, Page 31, of the
Public Records of Broward County, Florida.
It is the intention of the party of the first part by this
instrument to convey to the said city, and its successors in
interest, the land above described for use as a public road right-
of-way and for all purposes incidental thereto.
The said party of the first part will defend the title to
said land against the lawful claims of all persons whomsoever,
claiming by, through or under it.
IN WITNESS WHEREOF, the said party of the first part has
signed and sealed these presents on this, the day and year first
above written.
