R-85-,;V5 2 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER N0. 3 005-1 FOR CURTIS FI-ELD; AND PROVIDING AN EFFECTIVE DATE. 4 WHEREAS, pursuant to the instructions of the City Council of Tamarac, 5 Florida, a public meeting has been advertised in accordance with applicable law 6 of the date, time and place of the meeting regarding the review of the application 7 for a revised development order by the applicant for development approval;'and 8 WHEREAS, the City Council has examined and investigated the applica- 9 tion, staff and Planning Corimiission recommendations; and the attached Development 10 Review Status Sheet dated 1/18/85; and 11 WHEREAS, the City Council reviewed the revised development order and 12 accompanying documents at a public meeting; and 13 WHEREAS, the City Council has determined that the application is in 14 compliance with all elements of the Comprehensive Plan, or will be in compliance 15 prior to the issuance of a Certificate of Occupancy for the development that is 16 the subject of the application. 17 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TAMARAC, FLORIDA: 18 SECTION 1: That the application for approval of a development order 19 for Curtis Field, revised 1/18/85, is approved subject to the following 20 conditions: 21 A. Construction is to be in complete compliance with the plans and 22 specifications submitted by the developer to the City of Tamarac as described in 23 Section II of the Development Review Status Sheet and approved engineering 24 drawings. 25 B. Commencement of construction shall be no longer than one year from 26 the date of this approval. If the development does not commence construction 27 within one year, this approval is null and void unless an extension has been 28 granted in accordance with applicable regulations. 29 C. The revised development order is assignable, but an assignment 30 does not disdharge any assignee from strict compliance with the order unless the 31 City Council consents to modify any of the original requirements. 32 ` 33 o 34 t� !► Temp. Additional conditions established in order to issue the revised development order are set forth as follows: 1. Council to consider construction of or waiver to requirements for seawall at the time of site plan review. SECTION 2: Should any section or provision of this revised develop- ment order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This revised development order as conditioned shall become effective immediately upon its passage. PASSED, ADOPTED AND APPROVED this v73,/ day of , 1985.
