A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER NO. 121-1 FOR A REVISED SITE PLAN FOR WOODLANDS DAY SCHOOL; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a revised development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations; and the attached Development Review Status Sheet dated 10/4/85; and WHEREAS, the City Council reviewed the revised development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for approval of a revised site plan for Woodlands Day School, prepared by Daniel Griffin Associates, Inc., revised October 2, 1985, is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. B. Commencement of construction shall be no longer than one year from the date of this approval. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the revised development order are set forth as follows: 1 - No building permits will be issued until the fire flow calculations are adequate for a 6-inch main. 2 - The sidewalk requirement on NW 70 Avenue is waived. ,9ECTION 2: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This revised development order as conditioned shall become effective immediately upon its passage. Council to consider waiving sidewalk requirement on NW 70 Ave for the following reasons: a) Tamarac Point will be constructing a sidewal-k on the west side of NW 70 Ave to McNab Rd. b) The existing commercial structure to the north precludes a continuous sidewalk to McNab on the east side of the street. c) The Tamarac Point project was designed for pedestrians walking on the west side of the roadway. d) A sidewalk would prevent a true berm being constructed.
