CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-85- 3 6 D
A RESOLUTION APPROVING AND ACCEPTING A
DECLARATION OF PARKING COVENANT OFFERED
BY HCA REALTY, INC., FOR UNIVERSITY
COMMUNITY HOSPITAL; AND PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the Declaration of Parking Covenant by
HCA Realty, Inc., for University Community Hospital, is hereby
approved and accepted, a copy of said Declaration being attached
hereto as Exhibit A.
SECTION 2: That the City Clerk is hereby authorized and
directed to record said Declaration in the public records of
Broward County, Florida.
SECTION 3: This Resolution shall become effective upon
adoption.
PASSED, ADOPTED AND APPROVED this/3 day of 1985.

DECLARATION OF PARKING COVENANT
WHEREAS, HCA Realty, INC., a Tennessee corporation, is the
owner of that certain property more particularly described in
Exhibit A attached hereto and made a part hereof, hereinafter
referred to as the "Subject Property"; and,
WHEREAS, the Subject Property is situate, lying and being
in the municipal corporate limits of the City of Tamarac; and,
WHEREAS, UNIVERSITY COMMUNITY HOSPITAL, acting as agent
for HCA REALTY, INC., has asked the City of Tamarac -to rezone
the Subject Property to allow the same to be used as parking
as and for the University Community Hospital, its office build-
ing(s) and related amenities and facilities adjacent to the Sub-
ject Property; and,
WHEREAS, the City of Tamarac is amenable to the foregoing,
provided HCA REALTY, INC. declares of Public Record that the
Subject Property shaii oe used solely and only for parking for
the University Community Hospital, its office building(s) and
related amenities and facilities; and,
WHEREAS, it is to the best interests of HCA REALTY, INC.
and the City of Tamarac to do the foregoing and to cause the
intentions herein set forth to be recorded among the Public
Records of Broward County, Florida,
NOW, THEREFORE, be it declared that:
1. The Subject Property shall be used solely and only
as and for parking for the University Community Hospital, its
office building(s) and related amenities and facilities now or
hereinafter in place.
2. The term of this declaration shall be for a period
of fifty (50) years and shall be automatically renewable for
successive periods of fifty (50) years unless the owner of the
Subject Property AND the City of Tamarac acting by and through
its City Council agree to terminate this restrictive
declaration. The intent hereof is that this declaration can
only be changed, modified or terminated during the first fifty
(50) year term or any renewal thereof, upon the agreement of
the owner of the Subject Property and the City of Tamarac,
acting tnrough a resolution by its City Council.
IN WITNESS WHEREOF, HCA REALTY, INC., has set its hand this
1st day of November 1985.
