R-85-� 3 A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 148-1 FOR A.REVISED SITE PLAN FOR TAMARAC 4 PARK RECREATION CENTER FOR RECREATION BUILDING; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regard- ing the review of the application for a development order by the 9 applicant for development approval; and WHEREAS, the City Council has examined and investigated the appli- cation, staff and Planning Commission recommendations; and the 12 attached Development Review Status Sheet dated 2/7/85; and 13 WHEREAS, the City Council reviewed the development order and 14 accompanying documents at a public hearing; and 15 WHEREAS, the City Council has determined that the application is in a compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the 8 development that is the subject of the application. 9 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TAMARAC, FLORIDA: SECTION 1: That the application for approval of a revised site plan for Tamarac Park Recreation Center prepared by Richard S. Rubin, A.I.A., revised 2/6/85, for revised site plan for recreation buildin,, 23 is approved subject to the following conditions: 24 A. Construction is to be in complete compliance with the plans and 25 specifications submitted by the developer to the City of Tamarac as 26 described in Section II of the Development Review Status Sheet and 27 ZB approved engineering drawings. B. Commencement of Construction shall be no longer than one year 29 from the date of approval. If the development does not commence con- struction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. 33' 34 3S 36 I C. The development order is assignable, but an assignment does not 2 discharge any assignee from strict compliance with the order unless the 3 ity Council consents to modify any of the original requirements. 4 D. Additional conditions established in order to issue the develop- 8 9 3.2 23 14 3-5 t order are set forth as follows: 1. Relocate sewer lines and all utilities underneath building 2. Provide new fire hydrant within 300' of all parts of the build- ing. SECTION 2: Should any section or provision of this development order The declared by a court of competent jurisdiction to be invalid, the City JCouncil shall determine if the other portions of the order remain valid for whether the approval shall be null and void. SECTION 3: This development order as conditioned shall become effective upon adoption.
