R-85- 37Z 3 A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR THE 4 MIDWAY PLAZA PROJECT, DEVELOPMENT ORDFR NO. 176 AND PROMIDING AN EFFECTIVE DATE. _ 5 WHEREAS, pursuant to the instructions of the City Council 6 of the City of Tamarac, Florida, a public meeting has been adver- 7 tised in accordance with applicable law of the date, time and place 8 of the meeting regarding the review of the application for a 9 development order by the applicant for development approval; and 10 WHEREAS, the City Council has examined and investigated 11 the application, staff and Planning Commission recommendations, and 12 the attached Development Review Status Sheet dated 11/22/85; and 13 WHEREAS, the City Council reviewed the development order 14 and accompanying documents at a public meeting; and 15 WHEREAS, the City Council has determined that the appli- 16 cation is in compliance with all elements of its Comprehensive Plan, 17 or will be in compliance prior to the issuance of a Certificate of 18 Occupancy for any unit on the development that is the subject of the 19 application. 20 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 21 TAMARAC, FLORIDA: 22 SNTION-1: That the development described on the at- 23 tached development review status sheet dated 11 22 85 is p / / granted a 24 development order to proceed subject to the following conditions: 25 A. Construction is to be in complete compliance with the 26 plans and specifications submitted by the developer to the City of 27 Tamarac as described in Section II of the Development Review Status 28 Sheet and approved eng ineering gineering drawings. 29 B. Commencement of construction shall be no longer than 30 one year fkom the date of this ap proval. pproval. If the development does 31 not commence construction within one year, this approval is null and 32 void unless an extension has been granted in accordance with appli- 33 1 cable regulations. 34 TEMP. The development order is assignable, but an assign- ment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the development order are set forth as follows: 1) Approval of waiver of seawall 2) Show finished floor elevations of each building, street elevations, and site elevations 3) No building permits to be issued until the recorded plat and mylar are submitted to the City. SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. CTI 3: This development order as conditioned shall become effective immediately upon passage. PASSED, ADOPTED AND APPROVED this 27th_day of November , 1985.
