CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-85-�
A RESOLUTION ISSUING A DEVELOPMENT ORDER
FOR THE TAMARAC NURSING CENTER
PROJECT; DEVELOPMENT ORDER MO. 173 AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City Council of
the City of Tamarac, Florida, a public meeting has been advertised
in accordance with applicable law of the date, time and place of
the meeting regarding the review of the application for a develop-
ment order by the applicant for development approval; and
WHEREAS, the City Council has examined and investigated the
application, staff and Planning Commission recommendations, and the
attached Development Review Status Sheet dated November 22, 1985;
and
WHEREAS, the City Council reviewed the development order and
accompanying documents at a public meeting; and
WHEREAS, the City Council has determined that the application
is in compliance with all elements of its Comprehensive Plan, or
will be in compliance prior to the issuance of a Certificate of
Occupancy for any unit on the development that is the subject of
the application.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1; That the development described on the attached
development review status sheet dated Nov.22,1985 is granted a
development order to proceed with filing the plat for recordation
with Broward County Board of County Commissioners.
A. Additional conditions established in order to issue the
development order are set forth as follows:
1. Approval subject to Council acceptance of Agreement re-
garding assisted living units and Deed Restriction
regarding ACLF parking.

SECTION 2: Should any section or provision of this
development order be declared by a court of competent jurisdic-
tion to be invalid, the City Council shall determine if the other
portions of the order remain valid or whether the approval shall be
null and void.
SECTION 3: This development order as conditioned shall be-
come effective immediately upon passage.

Dear Mrs. Massaro:
Please accept this letter as acknowledgement of a
conversation held in your office on November 21, 1985
whereby we discussed the payment of fees for the pending
"Traffic Light Fund Ordinance."
I am authorized to inform you on behalf of Mr. Paul
Sieben, of Health Care and Retirement Corporation of
America, its Vice President of Construction, that if the
ordinance is adopted prior to the approval of the
Tamarac Nursing Center site plan, H.C.R. Corporation
will pay to the City of Tamarac a fee of $9,450.00
towards the "Traffic Signalization Fund, and a fee of
$9,205.00 for a M1 oil

If the ordinance is not adopted prior to the site plan
approvals but is adopted prior to the issuance of a
Building Permit for the Tamarac Nursing Center, H.C.R.
Corporation will pay the above stated fees at the time
of pulling a building permit.
