That ,,70ODMONT CCRPOR7-TION, is the present owner of a parcel of land which lies within Land Section 4 in the City of Tamarac, and therefore as successor to the Plaintiff is a proper party to this stipulation. 2. The property which is the subject of this Stipulation is Woodmont Tract 59. A legal description is attached as Exhibit A. 3. The developer and the City have agreed that the property which is the subject of this Stipulation shall oe developed with the maximum of a two floor building in compliance with all requirements of Tamarac City Code as amended from time to time as shown on the site plan dated November 14, 1985 (Exhibit B attached) unless otherwise indicated below: a. Front setback shall not be less than twenty (20) feet. b. Side setback shall not be less than twenty (20) feet. c. Rear setback shall not be less than twenty-one (21) feet at canal, fifteen (15) feet adjacent to S-1 zoned property. 4. Both parties agree to use reasonable and due diligence and good faith efforts to carry forth the terms of this Stipulation as contained herein. 5. This Stipulation may be filed in the above -captioned cause by any party, ex-parte, for the entry of an appropriate order ratifying and confirming the terms hereof. -1- 6.
