R-85- YS1/ 2 3 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER NO. 0155--1 FOR A REVISED SITE PLAN FOR JASMINE 4 AT WOODMONT (TRACT 68); AND PROVIDING AN EFFEC- TIVE DATE. 5 6 WHEREAS, pursuant to the instructions of the City Council of 7 Tamarac, Florida, a public meeting has been advertised in accor- 6 dance with applicable law of the date, time and place of the 9 meeting regarding the review of the application for a revised 10 development order by the applicant for development approval; and 11 WHEREAS, the City Council has examined and investigated the 12 application, and staff recommendations; and the attached Devel- 13 opment Review Status Sheet dated 12/6/85; and 14 WHEREAS, the City Council reviewed the revised development 15 order and accompanying documents at a public meeting; and 16 WHEREAS, the City Council has determined that the application 17 is in compliance with all elements of the Comprehensive Plan, or 18 will be in compliance prior to the issuance of a Certificate of 19 Occupancy for the development that is the subject of the applica- 20 tion. 21 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 22 TAMARAC, FLORIDA: 23 ,SEfTIQN 1: That the application for approval of a revised Z4 site plan for Jasmine at Woodmont (Tract 68) revised December 2, 25 1985, to reflect revised setbacks for Building 3 is approved sub- 26 ject to the following conditions: 27 A. Construction is to be in complete compliance with the 28 plans and specifications submitted by the developer to the City of 29 Tamarac as described in Section II of the Development Review 30 Status sheet and approved engineering drawings. 31 B. Commencement of construction shall be no longer than one 32 year from the date of this approval. If the development does not 33 commence construction within one year, this approval is null and 34 void unless an extension has been granted in accordance with applicable regulations. 1 0 i� I TEMP. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirement. D. Additional conditions established in order to issue the development order are set forth as follows: SECTION 2: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other por- tions of the order remain valid or whether the approval shall be null and void. ,SECTION 3: This revised development order as conditioned shall become effective immediately upon its passage.
