A RESOLUTION ACCEPTING A DECLARATION OF
RESTRICTIONS FROM HEALTH CARE AND RETIRE-
MENT CORPORATION OF AMERICA FOR TAMARAC
NURSING CENTER; AUTHORIZING ITS EXECUTION;
AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED, BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SFCTIQN 1: That the Declaration of Restriction offered
by Health Care an Retirement Corporation of Tamarac for Tamarac
Nursing Center prohibiting any resident of any assisted living
unit (A.C.L.F) on the property from parking or storing any type of
motor vehicle on or adjacent to the property, a copy of which is
attached as Exhibit "l", is HEREBY APPROVED.
SECTION 2: That the appropriate City officials are hereby
authorized to execute said Declaration of Restriction.
SECTION 3: That this Resolution shall become effective
immediately upon its adoption.

DECLARATION OF RESTRICTIONS
WHEREAS, Health Care and Retirement Corporation of
America, hereinafter called Declarant, is the owner of that certain
real property located in Broward County, Florida and more parti-
cularly described in Exhibit A attached hereto, hereinafter called
the Property; and
WHEREAS, the. Declarant is desirous of using and conve;,ing
the Property subject to a certain restriction as to its use;
NOW, THEREFORr, it is hereby declared that the Property
shall be held, used, sold and conveyed subject. to the following use
restriction which sh -'..l _un with the Property and shall be binding
on all parties having any right, title, or interest in or to the
Property or any part thereof, and their respective heirs,
successors and assigns. This restriction shall remain in effect
for 50 years from its execution unless released by resolution of
the City Council of Tamarac, Florida:
Restriction
No resident of any assisted living (ACLF) unit on the
property shall, park or store any type of motor vehicle on or
adjacent to the Property.
