R--85-%)1, A RESOLUTION APPROVING AND ACCEPTING A PUBLIC SAFETY INGRESS/EGRESS EASEMENT OFFERED BY HEALTH CARE AND RETIREMENT CORPORATION FOR TAMARAC NURSING CENTER; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1.: That the public safety ingress/egress easement offered by Health Care and Retirement Corporation for Tamarac Nursing Center project, is HEREBY APPROVED and ACCEPTED, a copy of said easement being attached hereto as Exhibit "l". SECTION 2: That the appropriate city officials are hereby authorize to execute this easement on behalf of the City. SECTION 3: The City Clerk is hereby authorized and direc- ted to record said utility easement in the public records of Broward County, Florida. W I T N E S S E T H: WHEREAS, Grantor is the fee simple owner of the real pro - party described on Exhibit "A" attached hereto; (the "Property") and WHEREAS, Grantor desires to create a non-exclusive easement in favor of grantee for ingress and egress over the property, as indicated on Exhibit "A", upon the terms and conditions set forth herein. NOW, THEREFORE, in consideration of the sum of One Dollar ($1.00) paid to Grantor, the receipt and adequacy of which is hereby acknowledged, and for other good and valuable considerations, Grantor does hereby create, establish and grant a non-exclusive easement on, over, under and through the Property to Grantee for the purpose of permitting public ingress and egress across the property to provide municipal services such as utility services, fire protection, police protection and emergency and other public safety services and canal maintenance.
