3 A RESOLUTION ISSUING DEVELOPMENT ORDER NO.
0-56-4 FOR A REVISED SITE PLAN FOR KINGS
4 POINT RECREATION COMPLEX FOR TEMPORARY
SERVICE DRIVEWAY; AND PROVIDING AN EFFECTIVE
5 DATE.

7 WHEREAS, pursuant to the instructions of the City Council of
8 Tamarac, Florida, a public meeting has been advertised in accordance
q with applicable law of the date, time and place of the meeting regard-
10 ing the review of the application for a development order by the
11 applicant for development approval; and
12 WHEREAS, the City Council has examined and investigated the appli-
13 cation, staff and Planning Commission recommendations; and the
14 attached Development Review Status Sheet dated 2/7/85; and
15 WHEREAS, the City Council reviewed the development order and
16 accompanying documents at a public hearing; and
17 WHEREAS, the City Council has determined that the application is
18 in compliance with all elements of the Comprehensive Plan, or will be
19 in compliance prior to the issuance of a Certificate of Occupancy for
20 the development that is the subject of the application.
21 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TAMARAC, FLORIDA:
22 SECTION 1: That the application for approval of a revised site
23 plan for Kings Point Recreation Complex prepared by F & R Builders,
24 fok temporary service driveway is approved subject to the following
25 conditions: .
26 A. Construction is to be in complete compliance with the plans
27 and specifications submitted by the developer to the City of Tamarac
28 as described in Section II of the Development Review Status Sheet and
29 approved engineering drawings.
30 B. Commencement of construction shall be no longer than one year
31 from the date of approval. If'the development does not commence
32 construction within one year, this approval.is null and void unless an
33 extension has been granted in accordance with applicable regulations.

1 C. The development order is assignable, but an assignment does
Z not discharge any assignee from strict compliance with the order
3 unless the City Council consents to modify any of the original
4 requirements.
5 D. Additional conditions established in order to issue the
6 development order are set forth as follows:

8 SECTION 2: Should any section or provision of this development
9 order be declared by a court of competent jurisdiction to be invalid,
10 the City Council shall determine if the other portions of the order
11 remain valid or whether the approval shall be null and void.
12 SECTION 3: This development order as conditioned shall become
13 effective upon adoption.
