RESOLUTION NO. R-85-_,�4Z
A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 130-1
FOR ISLAND CLUB APARTMENTS REVISED SITE PLAN TO
LOWER FINISH FLOOR ELEVATIONS TO 10.2 FEET
MINIMUM; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City Council of
Tamarac, Florida, a public meeting has been advertised in accordance
with applicable law of the date, time and place of the meeting regard-
ing the review of the application for a development order by the
applicant for development approval; and
WHEREAS, the City.Council has examined and investigated the appli-
cation, staff and Planning Commission recommendations; and the attached
Development Review Status Sheet dated 2/7/85; and
WHEREAS, the City Council reviewed the development order and accom-
panying documents at a public meeting; and
WHEREAS, the City Council has determined that the application is
in compliance with all elements of the Comprehensive Plan, or will be
in compliance prior to the issuance of a Certificate of Occupancy for
the development that is the subject of the application.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TAMARAC, FLORIDA:
SECTION 1: That the application for approval of a revised site
plan for Island Club Apartments prepared by D. M. Ambrose Associates,
Inc., to lower finish floor elevations to 10.2 feet minimum, is
approved subject to the following conditions:
A. Construction is to be in complete compliance with the plans
and specifications submitted by the developer to the City of Tamarac as
described in Section II of the Development Review Status Sheet and
approved engineering drawings.
B. Commencement of construction shall be no longer than one year
from the date of approval. If the development does not commence con-
struction within one year, this approval is null and void unless an
extension has been granted in accordance with applicable regulations.

C. The development order is assignable, but an assignment does not
2 1discharge any assignee from strict compliance with the order unless the

(City Council consents to modify any of the original requirements.
D. Additional conditions established in order to issue the develop-
Iment order are set forth as follows:
1. Developer must construct each building with the finish floor
18" above the average height of the adjacent roadway.
2. No building permits to be issued until the South Florida Water
Management District and Broward County Water Resources approve
the request.
SECTION 2: Should any section or provision of this development
order be declared by a court of competent jurisdiction to be invalid,
the City Council shall determine if the other portions of the order
remain valid or whether the approval shall be null and void.
SECTION 3: This development order as conditioned shall become
effective upon adoption.

Project subject to the requirements included in the Report and the following
conditions: .`
Developer initially made his calculations from the South Florida Water
Management District and indicated the 100 year storm at 10.7' and the
minimum road at 9.8'. He has now submitted a request for change to
South Florida Management District and Broward County Resource Division
to allow show minimum 10.2' finish floor and 9.3' at road -the request
is being reviewed by these agencies at the present time- County standards
permit 10.0'.
Staff recommends Council approval of the request, subject to the following:
1) Developer must construct each building with the. finish floor 18" above
the average height of the adjacent roadway.
2) No building permits to be issued until the South Florida Water Management
District and Broward County Water Resources approve the request.
