RESOLUTION NO. R-85- ZI_
A RESOLUTION ISSUING REVISED DEVELOPMENT
ORDER NO. 098--2 FOR A REVISED SITE PLAN
FOR SPYGLASS; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, pursuant to the instructions of the City Council of
Tamarac, Florida, a public meeting has been advertised in accordance
with applicable law of the date, time and place of the meeting regard-
ing the review of the application for a revised development order by
the applicant for development approval; and
WHEREAS, the City Council has examined and investigated the
application, staff and Planning Commission recommendations; and the
attached Development Review Status Sheet dated 2/22/85; and
WHEREAS, the City Council reviewed the revised development order
and accompanying documents at a public meeting.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAPRA.RAC,
FLORIDA:
SECTION 1: That the application for approval of a revised site
plan for Spyglass, prepared by Davis and Craven, Inc. revised
JAnuary 12, 1985, to allow all unit owners to receive building permits
for front, side and rear yard roofed enclosures provided they are not
placed in any set back or easement, is approved subject to the followin
conditions:
A. Construction is to be in complete compliance with the plans
and specifications submitted by the Condominium Association to the City
of Tamarac as described in Section II of the Development Review Status
Sheet.
B. The revised development order is assignable, but an'. assignment
does not discharge any assignee from strict compliance with the order
unless the City Council consents to modify any of the original
quirements .

1 C. Additional conditions established in order to issue the
2 revised development order are set forth as follows:
3 1 - No encroachments into municipal setbacks or easements.
2 - Spyglass Homeowners Association must approve all building
4 permit applications.
3 - Private parking provided must comply with City Code.
5 4 - These roofed enclosures on existing slabs may not be used
for living quarters or bedrooms nor have bathrooms.

SECTION 2: Should any section or provision of this revised

development order be declared by a court of competent jurisdiction
9
to be invalid, the City Council shall determine if the other portions
10
of the order remain valid or whether the approval shall be null and
11
void.

SECTION 3: This revised development order as conditioned shall
become effective immediately upon its passage.
