R-85- otk- A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER NO. 055-4 FOR A REVISED SITE PLAN FOR 3 LAKES PLAZA; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regard-1 ling the review of the application for a revised development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations; and the ;attached Development Review Status Sheet dated 2/1/85; and WHEREAS, the City Council has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy Ifor the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TABlARAC, FLORIDA: SECTION 1: That the application for approval of revised site plan for 3 Lakes Plaza,'prepared by D.M. Ambrose Associates, Inc., revised February 22, 1985 to reflect addition of a dumpster for Bays 19 and 20 and a parking space for the proposed Cafe Continental Restaurant, is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. 28 B. Commencement of construction shall be no longer that one year 29 from the date of this approval. If the development does not commence 30 construction within one year, this approval is null and void unless an 1 xtension has been granted in accordance with applicable regulations. 32 C. The revised development order is assignable, but an assignment 33 1does not discharge any assignee from strict compliance with the order 34 �nless the City Council consents to modify any of the original require- nts. Additional conditions established in order to issue the revis development order are set forth as follows: SECTION 2: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This revised development order as conditioned shall become effective immediately upon its passage.
