A RESOLUTION ACCEPTING A UTILITY EASEMENT OF-
FERED BY TOLL DEVELOPMENT CORP. FOR SOUTHGATE
GARDENS EAST.
NOW, THEREFORE, BE IT RESOLVED,BY COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the utility easement offered by Toll
Development Corp. for Southgate Gardens - East, is hereby ACCEPTED
subject to Toll Development Corp..submitting proof of ownership of
said lands, copy of which easement and description are attached
hereto as Exhibit A.

UTILITY EASEMENT
THIS UTILITY EASEMENT, executed this day of , 1980, by
TOLL DEVELOPMENT CORP. - SOUTHGATE, a Florida corporation, a Florida corpora-
tion, hereinafter referred to as "Grantor", to the CITY OF TAMARAC, a munici-
pal corporation, formed under the laws of the State of Florida, its successors
and assigns, hereinafter referred to as "Grantee"
W I T N E S S E T H:
FOR AND IN CONSIDERATION of Ten Dollars ($10.00) and other good and
valuable considerations paid by the Grantee to the Grantor, the receipt of
which is hereby acknowledged, the Grantor hereby grants unto the Grantee, its
successors and assigns, a non-exclusive easement, for utility purposes, and
ingress and egress in connection therewith, over, across, under and through
the following described lands:
SEE EXHIBIT "A" ANNEXED HERETO AND MADE A PART HEREOF.
TO HAVE AND TO HOLD the same unto Grantee, its successors and assigns,
forever.
IN WITNESS WHEREOF, the said Grantor has caused these presents to be
signed in its name the day and year first above written.
