HomeMy WebLinkAboutCity of Tamarac Resolution R-80-166Introduced by: OAn Temp. #19061 1 CITY OF TAMARAC, FLORIDA 2 RESOLUTION NO. 3 A RESOLUTION SEEKING RELIEF FROM THE BROWARD COUNTY 4 ENVIRONMENTAL QUALITY CONTROL BOARD FROM REGULATION NO. 79-1 WHICH AMENDED SECTION 27-119(b) OF THE CODE 5 OF REGULATIONS OF THE BROWARD COUNTY ENVIRONMENTAL QUALITY CONTROL BOARD PERTAINING TO EFFLUENT STANDARDS: PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Tamarac has acquired the assets of 8 Tamarac Utilities, Inc., and 9 WHEREAS, the City of Tamarac has assumed the obligations of 10 Tamarac Utilities, Inc., pursuant to a Large User Wastewater 11 Agreement with Broward County, Florida, and 12 WHEREAS, said Large User Agreement provides for transmission 13 of all of the effluent in the service area formerly served by 14 Tamarac Utilities, Inc. to Broward County, and 15 WHEREAS,the City of Tamarac is totally dependent upon 16 Broward County's completion of its wastewater treatment plant and 17 transmission facilities to the plant, and 3 WHEREAS, Environmental Quality Control Board Regulation #79-1 requires all waste discha.rLzes to meet the standards embodied 20 in Section 27-118(b) of the Code of Regulations of the Broward 1 21 County Environmental Quality Control Board by July 1, 1983, and 22 WHEREAS, said regulation also requires all owners of sources 23 of waste discharges that do not meet certain standards to agree. 24 with the Environmental Quality Control Board prior to July 1, 1981 25 that the waste discharge will be discontinued on or before July 26 1, 1983 or that there be an application pending with the Florida 27 Department of Environmental Regulation for a construction permit 28, for facilities to meet certain standards and a formal statement from 29 a licensed professional engineer in the State of Florida that the facilities will be constructed in time to meet the requirements of j the Board, and 32 WHEREAS, Tamarac is unable to meet either of these require 33 ments until the work to be performed by County is in fact done 34 by the County, and 35 WHEREAS, the standards may not be able to be met if the 36 proposed NLS 7 and appurtenantforce mains are not constructed on 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 11 20 21 22 23 24 25 26 27 28 29 yi 32 33 34 35 36 schedule by Broward County, and WHEREAS, Broward County does not appear to have proceeded very far along in acquiring funds to construct an NLS 7 and appurtenant force mains. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: All recitations set forth above are true and correct. SECTION 2: The City of Tamarac seeks relief from Broward County Environmental Quality Control Board Regulation #79- 1 until such time as the facilities available through Broward ,County pursuant to the Large User Wastewater Agreement currently in existence to handle the wastewater generated by the City. SECTION 3: This resolution shall become effective upon adopting.
