RESOLUTION NO. R-80-175
A RESOLUTION GRANTING A LIMITED WAIVER OF PARKING
REQUIREMENTS FOR DRS. BAKER AND LEVINE
WHEREAS, Chapter 18 of the Tamarac City Code provides that
Council may grant a limited waiver of the off-street parking and
loading requirements whenever a hardship would exist by adhering
to strict application thereof, and further provides that the
waiver would not be detrimental to public safety, health and
welfare of the citizens of the City; and
WHEREAS, a hardship exists at the proposed Medical Office
Building as stated in letter of Frank C. Snedaker, Jr. Architect,
dated May 30, 1980, copy of which is attached, hereto, as
Exhibit "A".
WHEREAS, the Planning Commission has held a public hearing
thereon and has made a recommendation; and
WHEREAS, the City Council desires to take action on the
limited waiver requested in the application of Drs. Baker and Levine.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the application for a limited waiver tb
Chapter 18 of the Tamarac City Code under the new ordinances to
allow use of fourteen (14) 901 parking spaces for employees and
such limited waiver would not be detrimental to public safety,
health and welfare of the citizens of the City.
SECTION 2: This Resolution will become effective immediately
upon its final passage.

Dear Sir:
We respectfully request a limited waiver with regard to required parking
spaces on the above referenced site.
There are a number of hardships existing which cause us to believe we
should be granted this request.
1. After preliminary site plan review which was approved April 2, 1980,
Council passed an ordinance revising the handicapped parking
requirements.. Our plan was in conformance prior to this new
ordinance.
2. The site creates an undue hardship by reason of its zoning (B 6),
which stipulates the first 25 ft. of the property adjacent to a
street right of way shall be maintained as landscaped area with
no parking permitted. This particular site is bounded on both the
north and the south by roadways thus creating a dual hardship.
3. This particular site requires by plat certain street set backs which
are far in excess of those required by the zoning ordinances. This
creates additional restrictions in laying out building and parking
lot locations.
We would request that a limited waiver grant a reduction of two parking
spaces under the new ordinance maintaining the 29 total parking
spaces on our approved site, or that it grant the use of 12 _ 90'
parking spaces fof use by employees in lieu of 10 angled parking
•bpaces .
