'BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA SECTION I: That the Amendment to Contract for Solid Waste Collection and Disposal relating to separate franchise for newspaper collection is hereby approved. ATTEST: ` CITY CLERK I HEREBY CERTIFY that I have approved the form and - correctness of this RESOLUTION. �ti��_�.��_1• G��%t MAYOR: CITY ATTORNEY DISTRICT DISTRICT DISTRICT DISTRICT RECORD OF COUNCIL VOTE S � N , �3 ►r �-go-ISb o• AMENDMENT TO CONTRACT FOR SOLID WASTE COLLECTION AND DISPOSAL THIS AMENDMENT TO CONTRACT made and entered into the U25'"day of, 1980, by and between the CITY F 510(_� 0 TAMARAC, a municipal corporation of the State of Florida (hereinafter referred to as "CITY"), acting by and through its duly authorized City Council and BROWNING-FERRIS INDUSTRIES OF FLORIDA, INC., (hereinafter referred to as "CONTRACTOR"). WITNESSETH: WHEREAS, CITY and CONTRACTOR entered into a contract for solid waste collection and disposal on October 5, 1979, and WHEREAS, the contract provided in paragraph 5F of the specifications attached and incorporated therein that the CITY may establish a program for newspaper collections and in such event the terms of the contract may be reopened, and program. WHEREAS, the CITY has established a newspaper collection NOW, THEREFORE, FOR THE MUTUAL BENEFITS AND OTHER CONSIDERATIONS RECITED HEREIN, THE PARTIES AMEND THE AGREEMENT AS FOLLOWS: 1. The exclusive right to collect all garbage, trash and refuse, and the statement that title to all garbage, trash and refuse are to be vested in the CONTRACTOR upon the effective date of the con- tract are hereby modified to the extent that newspapers may be bundled and collected by a franchisee of the CITY. Title to the newspapers shall be vested in that franchisee at the time the newspapers are picked up. 2• CONTRACTOR shall deduct from billing to the CITY the amount of tonnage -certified by the franchisee for newspaper collection as being picked up during a particular month times one-half of the dumping charge. For example, if the dumping charge were $9.00 a ton the CITY would be entitled to a reduction of $4.50 a ton for each ton of paper certified by the franchisee as having been picked up by the franchisee. 3. In the event that CITY revokes, cancels or other- wise terminates a franchise, the terms and conditions of the contract exclusive of this Amendment shall be reinstated, and shall be effective upon receipt of written notice from the CITY to the CONTRACTOR that the franchise has been terminated. 4. This Amendment shall be effective upon approval of the Tamarac City Council and the CONTRACTOR.
