BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA SECTION I: That the Utility and Drainage Easement along the West side of Notthwest 88th Avehue on Woodview Tract 38 as recorde< in Plat Book 103, Page 34, of -the Public Records of Broward County, is hereby approved and accepted. SECTION 2:That the City Clerk is hereby instucted to record said easement in the Official Records of Broward County, Florida, PASSED, ADOPTED AND APPROVED this ,;iT_40day f ,1980. WITNESS-ETH: WHEREAS, the party(ies) of the first part is/are the owner(s) of property situate in Broward County, Florida, and described as follows: That Utility and Drainage Easement along the West side of Northwest 88th Avenue as shown on Woodview Tract 38 plat as recorded in Plat Book 103, Page 34, of the Public Records -of Broward County and, "rtWHEREAS, the party of the socahas a utility easement on, over and across the property described above, and aW WHEREAS, the party of the ._ part desires to erect a fence over an existing utility easement on the above described property, and WHEREAS, the party(ies) of the first part want to grant an easement to clarify the rights of the party of the second part to enter on to its property at anytime to work in the easement and to remove or destroy all or part of the fence without the obligation to restore or repair same. NOW, THEREFORE, for and in consideration of the mutual covenants each to the other running and one dollar and other good and valuable considerations, the receipt of which is hereby acknowledged, the party(ies) of the first part do(es) hereby grant unto the party of the second part, its successors and assigns, full and free right and authority to construct, maintain, repair, install and rebuild facilities for all public purposes and do(es) hereby grant a perpetual easement on, over and across the above described property for said purposes. The party of the second part shall have the right to remove or destroy all or part of any fence or other structure constructed in the easement without the obligation to restore same.
