RESOLUTION NO. R- O
A RESOLUTION CORRECTING RESOLUTION NO. R-80-34
APPROVING A VACATION OF COVENANT FOR THE
WOODMONT NORTH GOLF COURSE.
WHEREAS, the City has heretofore on February 27, 1980, passed Resolution
No. R-80-34, approving a Vacation of Covenant for certain lands formerly in
the Woodmont North Golf Course, which were rezoned from S-1 to R-3U, and
WHEREAS, it was thereafter discovered by the Owner, City National Bank
of Miami, as Trustee under Trust No. 5003183, that there was a scrivener's
error in the legal description for Parcel R-3, and
WHEREAS, the City has passed Ordinance NO. �, rezoning Parcel
R-3 (as corrected) said corrected legal description bearing date of
May 14, 1980, from S-1 to R-3U, and
WHEREAS, the City has passed Ordinance No. rezoning the
incorrect Parcel R-3 (said Parcel R-3 legal description bearing date of
October.1, 1979), from R-3U back to S-1, and
WHEREAS, the City has received a copy of a Covenant which reimposes
the Golf Course Covenant on the incorrect Parcel R-3 (bearing date of
October 1, 1979), and
WHEREAS, the sketch in the Vacation of Covenant showing the location
of Parcel R-3 in the Woodmont Development was accurate.
NOW,, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the Corrective Vacation of Covenant for the
WOODMONT NORTH GOLF COURSE, Parcels R-1 through R-10 between the City and
Tract 76 Corp. and the City National Bank of Miami, as Trustee under Trust
No. 5003183, copy of which is attached hereto as Exhibit "A", is hereby
approved. Said Corrective Vacation of Covenant contains a corrected legal
description for Parcel R-3, which corrected description bears a date of
May 14, 1980.

SECTION 2: That the appropriate City Officials are hereby authorized
to execute said Vacation of Covenant.

WHEREAS, the CITY OF TAMARAC, a municipal corporation, pursuant to the
duly adopted Resolution Number R-80-6, dated the loth day of January, 1980,
and pursuant to the reserved authority of the CITY OF TAMARAC, pursuant to
Ordinance Number 72-14, dated July 12, 1972; and
WHEREAS, CITY OF TAMARAC, has rezoned certain parcels of real property.

THIS CORRECTIVE INSTRUMENT IS BEING RECORDED TO REFLECT A CORRECTION
IN THE LEGAL DESCRIPTION FOR PARCEL R-3. IN ALL OTHER RESPECTS THIS
INSTRUMENT IS IDENTICAL TO THAT VACATION OF COVENANT DATED MARCH 3, 1980,
AND RECORDED IN O. R. BOOK 8783, PAGE 944, OF THE PUBLIC RECORDS OF
BROWARD COUNTY, FLORIDA.
WHEREAS, CITY NATIONAL BANK OF MIAMI, as Trustee under the provisions
of that certain Trust Agreement dated the 14th day of September, 1978, and
known as Trust Number 5003183, and joined by TRACT 76 CORP., a Florida
&..L corporation, have encumbered certain real property with covenants in
conformance with the terms of Ordinance 72-14, all of which has been
recorded in the Public Records of Broward County, Florida; and
WHEREAS, it is the intention of CITY OF TAMARAC, joined by CITY
NATIONAL BANK OF MIAMI, as Trustee under the provisions of that certain
Trust Agreement dated the 14th day of September, 1978, and known as Trust
Number 5003183, joined by TRACT 76 CORP., a Florida corporation, to release
and vacate from the terms of the Covenants as recorded in 0. R. Book 6450,
Page 79, of the Public Records of Broward County, Florida, executed August
26, 1975, by SIMON ZUNAMON, and the terms of the Covenant as recorded in O.
R. Book 6890, Page 26, of the Public Records of Broward County, Florida,
executed December 21, 1976, by SIMON ZUNAMON, as Trustee, all of the real
property as described on Exhibit "A" attached hereto and made a part hereof,
which property was previously zoned S-1 and subject to the terms of the
recorded Covenants as recited above.
NOW, THEREFORE, the CITY OF TAMARAC, FLORIDA, pursuant to Resolution
No. R-80-6, and pursuant to the authority as reserved unto it by Ordinance
No. 72-14, joined by CITY NATIONAL BANK OF MIAMI, as Trustee under the
provisions of that certain Trust Agreement dated the 14th day of Septem-
ber, 1978, and known as Trust Number 5003183, joined by TRACT 76 CORP., a
Florida corporation, hereby releases and vacates, as the same apply to the
real property as set forth on Exhibit "A" attached hereto and designated:

O.R. Book 6450, Page 729 of the Public Records of Broward County, Florida;
and in that certain Covenant executed on December 21, 1976, by SIMON
.� ZUNAMON, as Trustee, under the provisions of that certain Trust Agreement

dated December 1, 1972, and known as Trust No. 101, and recorded in O.R.
Book 6890, Page 26 of the Public Records of Broward County, Florida; and
that said release and vacation shall take place and be effective as of the
date of the recording of this instrument within the Public Records of
Broward County, Florida.
This Vacation of Covenant is executed by CITY NATIONAL BANK OF MIAMI,
a United States banking corporation, as Trustee under the provisions of
that certain Trust Agreement dated the 14th day of September, 1978, and
known as Trust Number 5003183, solely in its capacity as Trustee, and not
in its independent corporate capacity, and no liability hereunder may be
asserted against its independent corporate capacity or against any bene-
ficiary of the Trust for which said CITY NATIONAL BANK OF MIAMI is Trustee
under that certain Trust Agreement dated the 14th day of September, 1978,
known as Trust Number 5003183.
