A RESOLUTION CORRECTING RESOLUTION NO. R-80-56
APPROVING THE VACATION OF UTILITY EASEMENT E-14
(AS CORRECTED) FOR WOODMONT NORTH GOLF COURSE.
WHEREAS, the City of Tamarac heretofore on February 27, 1980, passed
Resolution No. R-80-56, approving the vacation of Utility Easement E-14,
for Woodmont North Golf Course, and .
WHEREAS, it was thereafter discovered by the owner, City National Bank
of Miami, as Trustee under Trust No. 5003183, that the legal description
for E-14 contained a scrivener's error, which error resulted in the Easement
not being properly vacated, and
WHEREAS, the City of Tamarac and the owner wish to correct the legal
description and vacate Utility Easement E-14, as corrected.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1:• That the Vacation of Easement E-14 (as corrected under
date of May 14, 1980), for WOODMONT NORTH GOLF COURSE, offered by the Tract
76 Corp. and the City National Bank of Miami, as Trustee under Trust No.
5003183, copy of which is attached hereto as Exhibit "A", is hereby approved.
SECTION 2: The City of Tamarac is cognizant of the requirements] f
Section 177.101 F.S., and Chapter 28946 Laws of Florida, Special Acts of
1953, as amended from time to time, which sets forth a procedure for partial
vacation dedications granted in plats and this vacation is contingent upon
approval by the Broward County Board of County Commissioners and satisfaction
of all requirements of Section 177.101 F.S. and Chapter 28946 Laws of Florida,
Special Acts of 1953, as amended from time to time, within one year of the
date of this approval.
