CITY OF TAMARAC, FLORIDA
RESOLUTION NO.
A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT
WITH RISSMONT, INC., FOR DRAINAGE IMPROVEMENTS ON
WOODMONT TRACTS 74 AND 75
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the Agreement between the City and
Rissmont, Inc., for drainage improvements on Tracts 74 and 75, a copy
of which is attached as Exhibit "A", is hereby approved.
SECTION 2: The appropriate City officials are hereby
authorized to execute said Agreement on behalf of the City.

AGREEMENT
THIS AGREEMENT made and entered into this �� of
1980 between the City of Tamarac, a municipal
corporation in the State of Florida, hereinafter referred to as City,
and Rissmont, Inc. authorized to do business in the State of Florida.
W I T N E S S E T H :
FOR AND IN CONSIDERATION OF MUTUAL COVENANTS CONTAINED
HEREIN the sufficiency of which is hereby acknowledged the parties agree
as follows:
1. FINDINGS OF FACT - Rissmont, Inc. will be developing
the property described in Exhibit A attached hereto and made a part
hereof. It will be necessary for Rissmont to be doing certain drainage
improvement work both on and off of the premises described in Exhibit A.
The City desires drainage improvements to be made at certain intersections
adjacent to, or in close proximity to the property described in Exhibit A
which will benefit the property described in Exhibit A. Rissmont, Inc.
as part of this development agrees to perform certain of this work.
2. RISSMONT'S COMMITMENTS - Rissmont, Inc. shall perform
or cause to be performed the work set forth in the final engineering
drawings for the project as approved by the City Engineer, at the inter-
sections of N.W. 78th Street and N.W. 75th Street with N.W. 80th Avenue.
3. TIMING OF WORK - Rissmont agrees that all work that
it is committed to do shall be completed prior to the completion of
Phase 3 of the project. Phase 3 is described as shown on the approved
final engineering drawings in City Hall for Woodmont Tracts 74 and 75.
4. TERMINATION - This Agreement may be terminated by
Rissmont only if it does not acquire that property set forth in Exhibit A
herein within two years of the date hereof. All references to Rissmont,
Inc. shall also apply to any corporation owned by essentially the same
stockholders, or to any partnership or self proprietorship owned by any
of the stockholders of Rissmont, Inc.
THIS AGREEMENT shall be binding upon all successors in
interest to the property, and assignees or purchasers or any sort of
the property described in Exhibit A from Rissmont, Inc.
