A.RESOLUTION AUTHORIZING CITY OFFICIALS
TO EXECUTE a TEMPORARY USE AGREEMENT WITH
F & R BUILDERS, INC., in CONNECTION
WITH DRAINAGE WORK IN WESTWOOD
COMMUNITY 6.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the proper City officials are authorized
to execute the Temporary Use Agreement with F & R Builders,Inc., in
connection with drainage work in Westwood Community 6, a copy
of which Agreement and description are attached hereto.
SECTION 2: This Resolution shall become effective immediately
upon its passage.

TEMPORARY USE AGREEMENT
THIS AGREEMENT, made and entered into this 24th day of
November, 1980, by and between
F & R BUILDERS, INC., a Florida corporation, hereinafter
referred to as "Grantor";
and
CITY OF TAMARAC, a municipal corporation, Tamarac, Flor-
ida, hereinafter referred to as "Grantee".
***W I T N E S S E T H:***
WHEREAS, Grantor is the owner of land legally described
on Exhibits A, B and C attached hereto and, by this reference,
made a part hereof, hereinafter referred to as "drainage ditches";
and
WHEREAS, Grantor is also the owner of land legally described
on Exhibit D attached hereto and, by this reference made a part
hereof, hereinafter referred to as "Tracts 13-A and 13B"; and
WHEREAS, the drainage ditches are located on Tracts 13-A
and 13-B; and
WHEREAS, Grantee has been using said drainage ditches for
drainage purposes without the benefit of a written agreement; •-
and
WHEREAS, Grantor is applying for a site plan approval
from the Grantee on Tracts 13-A and 13-B, which, when approved
by Grantee, may require the relocation of the drainage ditches;
and
WHEREAS, Grantee has requested a written agreement, al-
lowing their use of the drainage ditches for drainage purposes
and Grantor has agreed to allow Grantee said use on a temporary
basis.
NOW, THEREFORE, in consideration of the mutual covenants
set forth herein, Grantor hereby grants to the Grantee, the tem-
porary use of the drainage ditches for drainage purposes under
the following terms and conditions:
1. The temporary use permit to Grantee shall expire when
Grantor and Grantee agree to a permanent location for the drain-
age ditches or one (1) year from the date hereof, whichever first
occurs.
2. Grantee shall be responsible for any damages that oc-
cur to Tracts 13-A and 13-B due to the use of the drainage ditches
for drainage purposes, including but not limited to, flooding of
Tracts 13-A and 13-B due to the overflow of water from the drain-
age ditches.
3. This Agreement shall be governed by .and subject to
the laws of the State of Florida.
4. This written Agreement is the entire agreement between
the parties. Any amendment to this Agreement shall be in writing
and executed by both the Grantor and the Grantee.
IN WITNESS WHEREOF, the parties hereto set forth their
