A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA, REQUESTING THE BROWARD
COUNTY LEGISLATIVE DELEGATION OF THE FLORIDA
LEGISLATURE TO SPONSOR LEGISLATION AMENDING
SECTION 287.055, FLORIDA STATUTES, CONSULTANTS'
COMPETITIVE NEGOTIATIONS ACT, TO PERMIT GOVERN-
MENTAL AGENCIES GREATER FLEXIBILITY IN RETAINING
PROFESSIONAL CONSULTANTS.
WHEREAS, the City Council of the City of Tamarac and all
governmental agencies are bound by the provisions of Section 287.055,
F.S., the Consultants' Competitive Negotiations Act, when they desire
to retain the professional services of an architect, engineer, land-
scape architect or registered land surveyor for a project whose basic
construction cost is estimated to be in excess of One Hundred Thousand
($100,000.00) Dollars or for a planning or study activity when the
fee for the professional services exceeds Five Thousand ($5,000.00)
Dollars except in cases of emergency; and
WHEREAS, it is sometimes difficult for governmental bodies
to obtain the desired services at the best available price due to
the requirements of the current law; and
WHEREAS, it would be in the best interest of the citizens of
the City of Tamarac and of the State of Florida to amend the Con-
sultants' Competitive Negotiations Act to allow true competitive
bidding;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, BROWARD COUNTY, FLORIDA:
SECTION
1:
That
the
foregoing recitals are true
and correct.
SECTION
2:
That
the
Broward County Legislative
Delegation
of the Florida Legislature be and is hereby requested to sponsor and
support legislation amending Section 287.055, F.S., the Consultants'
Competitive Negotiations Act, to allow governmental agencies greater
flexibility in negotiating fees with and in hiring professional
architects, engineers, landscape architects or`land
surveyors specifically with regard to the method of negotiating fees
with the various consultants.

SECTION 3: That the City Clerk of the City of Tamarac be
and is hereby directed to furnish copies of this Resolution to all
members of the Broward County Legislative Delegation of the Florida
Legislature and to the municipalities in Broward County.
