CITY OF TAMARAC, FLORIDA
RESOLUTION NO. ,eQ -3
A RESOLUTION PERTAINING TO N.W. 82ND AVENUE
WHEREAS, the right-of-way for N.W. 82nd Avenue in Tamarac has been
dedicated to the public for years, and
WHEREAS, the right-of-way for N.W. 82nd Avenue in Tamarac was
dedicated prior to the right-of-way for N.W. 82nd Avenue in Lauderhill; and
WHEREAS, Tamarac has no interest, desire or intention of vacating
any portion of N.W. 82nd Avenue in Tamarac; and
WHEREAS, a plat is pending before the County Commission (Commercial
Boulevard Shoppes Plat #1) which would include dedication of land for right-of-way
for N.W. 82nd Avenue adjacent to Tamarac in Lauderhill; and
WHEREAS, the right-of-way would create an offset intersection at
Commercial Boulevard; and
WHEREAS, the offset intersection could be avoided if the property
owner would modify the plat and line up the right-of-way with N.W. 82nd Avenue in
Tamarac; and
WHEREAS, offset intersections are dangerous, cause accidents and
constitute poor planning; and
WHEREAS, the staff of the County has recommended that the right -of -
line up with N.W. 82nd Avenue in Tamarac; and
WHEREAS, the County has a right and obligation to insist upon the
proper dedication on N.W. 82nd Avenue to avoid the creation of an offset inter-
section; and
WHEREAS, approval of the plat as currently constituted would
be poor planning, would unnecessarily create a dangerous situation and would be
a detriment to the preservation of the public health, safety and welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: The facts set forth in the Whereas clauses are adopted
and the County Commission is urged and implored to stand fast and insist that
there is a proper alignment of N.W. 82nd Avenue between Lauderhill and Tamarac
even if this means rejecting a proposed plat.
