A RESOLUTION APPROVING A VACATION OF
COVENANT FOR THE WOODMONT NORTH GOLF
COURSE.
WHEREAS, certain lands on or adjoining a portion of the
Woodmont North Golf Course have been rezoned and are not used for
golf course purposes any longer, and
WHEREAS, the rezonings have necessitated the vacation of the
covenant to allow a reasonable use of rezoned property, and
WHEREAS, the City has received a copy of a new covenant
which would restrict the use of properties that have been rezoned to
S-1 uses.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: That the Vacation of Covenant for the WOODMONT
NORTH GOLF COURSE, Parcels R-1 through R-10 between the City and
Tract 76 Corporation and the City National Bank of Miami, as Trustee
#5003183, copy of which is attached hereto as Exhibit "A," is hereby
approved.
SECTION 2: That the appropriate City Officials are hereby
authorized to execute said Vacation of Covenant.

by CITY OF TAMARAC, FLORIDA, a municipal corporation, joined
by CITY NATIONAL BANK OF MIAMI, a United States banking
corporation, as Trustee, under the provisions of that certain
Trust Agreement dated the 14th day of September, 1978, and
known as Trust No. 5003183, and TRACT 76 CORP., a Florida
corporation,
W I T N E S S E T H:
WHEREAS, the CITY OF TAMARAC, a municipal corporation,
pursuant to the duly adopted Resolution Number R-80-6, dated
the loth day of January, 1980, and pursuant to the reserved
authority of the CITY OF TAMARAC, pursuant to Ordinance
Number 72-14, dated July 12, 1972; and
WHEREAS, CITY OF TAMARAC, has rezoned certain parcels
of real property from a Residential classification to S-1
classification, and other real property from S-1 classifica-
tion to a Residential classification by virtue of Ordinances
Numbers 0-80-4 through 0-80-24; and
WHEREAS, CITY NATIONAL BANK OF MIAMI, a United States
banking corporation, as Trustee under the provisions of that
certain Trust Agreement dated the 14th day of September,
1978, and known as Trust No. 5003183, is a successor in
interest to SIMON ZUNAMON, as Trustee under the provisions
of a certain Trust Agreement dated December 1, 1972, and
known as Trust No. 101; and
WHEREAS, CITY NATIONAL BANK OF.MIAMI, as Trustee under
the provisions of that certain Trust Agreement dated the
14th day of September, and known as Trust No. 5003183, joined
by TRACT 76 CORP., a Florida corporation, are the owners of
all of the real property located within One Hundred Fifty
Feet (1501) of the exterior boundaries of the subdivision
within which the real property set forth on Exhibit "A"
attached hereto and designated "Woodmont North Golf Course,

10"; and
WHEREAS, CITY NATIONAL BANK OF MIAMI, as Trustee under
the provisions of that certain Trust Agreement dated the
14th day of September, 1978, and known as Trust Number
5003183, and joined by TRACT 76 CORP., a Florida corpora-
tion, have encumbered certain real property with covenants
in conformance with the terms of Ordinance 72-14, all of
which has been recorded in the Public Records of Broward
County, Florida; and
WHEREAS, it is the intention of CITY OF TAMARAC, joined
by CITY NATIONAL BANK OF MIAMI, as Trustee under the pro-
visions of that certain Trust Agreement dated the 14th day
of September, 1978, and known as Trust Number 5003183,
joined by TRACT 76 CORP., a Florida corporation, to release
and vacate from the terms of the Covenants as recorded in 0.
R. Book 6450, Page 729 of the Public Records of Broward
County, Florida, executed August 26, 1975, by SIMON ZUNAMON,
and the terms of the Covenant as recorded in 0. R. Book
6890, Page 26, of the Public Records of Broward County,
Florida, executed December 21, 1976, by SIMON ZUNAMON, as
Trustee, all of the real property as described on Exhibit
"A" attached hereto and made a part hereof, which property
was previously zoned S-1 and subject to the terms of the
recorded Covenants as recited above.
NOW, THEREFORE, the CITY OF TAMARAC, FLORIDA, pursuant
to Resolution No. R-80-6, and pursuant to the authority as
reserved unto it by Ordinance No. 72-14, joined by CITY
NATIONAL BANK OF MIAMI, as Trustee under the provisions of
that certain Trust Agreement
dated the 14th day of
September, 1978, and
known as
Trust Number 5003183, joined
by TRACT 76 CORP., a
Florida
corporation, hereby releases
and vacates, as the

under the provisions of that certain Trust Agreement dated
December 21,1972, and known as Trust No. 101, and recorded

County, Florida; and that said release and vacation shall
take place and be effective as of the date of the recording
of this instrument within the Public Records of Broward
County, Florida.
This Vacation of Covenant is executed by CITY NATIONAL
BANK OF MIAMI, a United States banking corporation, as Trustee
under the provisions of that certain Trust Agreement dated
the 14th day of September, 1978, and known as Trust Number
5003183, solely in its capacity as Trustee, and not in its
independent corporate capacity, and no liability hereunder
may be asserted against its independent corporate capacity
or against any beneficiary of the Trust for which said CITY
NATIONAL BANK OF MIAMI is Trustee under that certain Trust
