R- A RESOLUTION AUTHORIZING APPROPRIATE CITY OF- FICIALS TO EXECUTE AN AGREEHM WITH PATROL- MAN DAVID LOWEI FOR THE SERVICES OF HIS CANINE. WHEREAS, from time to time the City finds it necessary to use canines in order to assist the Police Department in matters pertaining to criminal justice; and WHEREAS, Patrolman David Lowe, owns a canine which he represents has been adequately trained to assist in criminal justice problems. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the appropriate City officials are authorized to execute an agreement with Patrolman David Lowe for the services of the canine that he owns to assist in criminal justice problems. SECTION 2: This Resolution will become effective immediately upon its final passage. J47tLlww.C�l "/' a7/%� G,'�y A` 0rl MAYOR: DISTRICT DIST CT DISTRICT DISTRICT � T car£ � �b,,C/���� �✓��� C'JCt"Z.�/T� y RECORD OF COUNCIL VOTE *- 7t r AGREEMENT THIS AGREEMENT made and entered into this- Z�Z day of 1980 between the CITY OF TAMARAC, a municipal corporation of the State of Florida, and DAVID LOWE, a certified Police Officer employed by the City of Tamarac, hereinafter referred to as OWNER, and owning a trained canine named LUCAN WHEREAS, from time to time the CITY finds it necessary to use canines in order to assist the Police Department in matters pertaining to criminal justice, and WHEREAS, OWNER owns a canine which he represents has been adequately trained to assist in criminal justice problems. W I T N E S S E T H : FOR AND IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN THE PARTIES AGREE AS FOLLOWS: 1. OWNER shall provide CITY with services of the canine that he owns, as needed, by CITY for the sum of $1.00 per year. 2. CITY shall assume responsibility for the following: a. Reimbursement to OWNER for actual cost of feeding canine with dog food. Reimbursement will occur after presentment of bills showing actual expenditures. Bills will be submitted no more frequently than monthly. b. Actual veterinary cost for vaccinations and injuries incurred by canine while on active duty. c. Supplemental training, if approved in advance in writing by the Chief of Police and City Manager. 1 1 d. Liability insurance limited to the time the canine is on duty for the CITY. (The canine may be assigned to assist police officers in other jurisdictions in which case responsibility for liability should rest with the jurisdiction being given assistance). 3. OWNER shall be responsible for liability and all damages caused by the canine while off duty. He shall provide CITY with proof of insurance in an amount equal to FIFTY THOUSAND AND NO/100 ($50,000.00) with CITY as an additional named insured to cover damage and injury caused by the canine while off duty. 4. This Agreement may be terminated by either party on thirty (30) days written notice and will automatically be terminated upon OWNER's leaving the employ of the CITY. 5. The term of this Agreement shall be for one (1) year of the date of its execution, however, its term shall extend automatically on a month to month basis after the one (1) year period and may be subject to the termination as set forth in the paragraph above.
