X,�84 4 A RESOLUTION AUTHORIZING PROPER OFFICERS OF THE CITY TO ACCEPT ON BEHALF OF THE CITY AN ASSIGNMENT OF LEASE TO CERTAIN RECREATIONAL LANDS AS THEREIN DESCRIBED FROM TAMARAC LAKES, INC., A FLORIDA CORPORATION. WHEREAS, BEHRING PROPERTIES, INC., a Florida corpora- tion, has offered to assign its interest in and to the hereinafter described lease, and WHEREAS, the Council of the City of Tamarac has con- sidered said offer and deems the same to be in the best interest of the said City as a method by which the City shall acquire the use of valuable recreation lands for its residents. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: 1. That this Council deems the offer of assignment made by BEHRING PROPERTIES, INC., in and to that certain Lease dated the 31st day of July, 1968, by and between TAMARAC MAIN- LAND, INC., a Florida corporation, as Lessor, and BEHRING PROPER- TIES, INC., as Lessee, and recorded in Broward County Official Records Book 37225, Pages 578 through 586, inclusive, on the 9th day 40 of August, 1968, to be in the best interest of the City. 2. That the Council accepts said offer of assignment for and on behalf of the City of Tamarac, Florida. 3. That the proper officials of the City be, and they are, hereby authorized and directed to e e cute an acceptance of assignment of the Lessee's interest in Julie aforesaid Lease. ADOPTED THIS 2nd day of Decemfber, 1968. 1 = Mayor ti is r--2 A G R E E M E N T THIS AGREEMENT made and entered into this 24th day of October, 1149,4 1967, by and between TAMARAC LAKES, INC., a Florida corporation, hereinafter referred to as LAKES and the CITY OF TAMARAC, a municipal corporation of the State of Florida, hereinafter referred to as TAMARAC. WITNESSETH: WHEREAS, TAMARAC has been in the process of purchasing from LAKES the sewer and water lines owned by LAKES which have been in- stalled in the City of Tamarac, and WHEREAS, TAMARAC does not have the ability to complete such purchase and pay the balance of $33,173.15 presently due to LAKES from TAMARAC and desires a refund of the $24,000.00 that TAMARAC has paid to LAKES toward the purchase of such sewer and water lines, and WHEREAS, LAKES is not presently in the position to repay to TAMARAC the $24,000.00 previously referred to, same having not been heretofore planned for repayment from LAKES to TAMARAC. NOW THEREFORE, for and in consideration of Ten Dollars ($10.00) IM01 and of the mutual covenants and agreements contained herein the parties hereto agree as follows: 1) TAMARAC does hereby reassign, transfer, convey and set over to LAKES, any and all interest it may have acquired in and to all the sewer and water lines presently installed within the following described subdivisions lying within the city limits of TAMARAC to belong to LAKES now and hereafter: Tamarac Lakes, a subdivision, according to the plat thereof recorded in Plat Book 58, Page 40 of the Public Records of Broward County, Florida. Tamarac Lakes 2nd, a subdivision, according to the plat thereof recorded in Plat Book 59, Page 46, of the Public Records of Broward County, Florida. Tamarac Lakes North, a subdivision, according to the plat thereof recorded in Plat Book 61, Page 7, of the Public Records of Broward County, Florida. Tamarac Lakes North 2, a subdivision, according to the plat thereof recorded in Plat Book 61, Page 8, of the Public Records of Broward County, Florida. Tamarac Lakes North 3, a subdivision, according to the plat thereof recorded in Plat Book 63, Page 7, of the Public Records of Broward County, Florida. Tamarac Lakes South, a subdivision, according to the plat thereof recorded in Plat Book 62, Page 24, of the Public Records of Broward County, Florida. 2) LAKES hereby agrees to pay to TAMARAC on or before December 22, 1967, the sum of $24,000.00 together with interest thereon at • four (4%) percent per annum, payable in Fort Lauderdale, Florida, with a 30 day grace period and interest from maturity to date of payment at eight (8%) percent per annum.' 3) In the event that LAKES fails to pay to TAMARAC the sums • due hereunder then in addition to.such sums and the interest thereon, LAKES agrees to pay all costs of collection, including a reasonable attorney's fee, whether suit be brought or not.
