HomeMy WebLinkAboutCity of Tamarac Resolution R-70-015RESOLUTION NO. 7 0 - I t51 STATE OF FLORIDA BROWARD COUNTY CITY OF TAMARAC A RESOLUTION APPROVING MUTUAL AID POLICE SERVICE AND AUTHORIZING LOCAL OFFICIALS TO PERFORM THEREUNDER. WHEREAS, C being muncipalities in Broward County, Florida are o located that it is to the advantage of each to extend aid to the others in respect to police department services, and, WHEREAS, it is recognized that the use of peace officers to perform police or peace duties outside the territorial limits of the municipality where such officers are regularly employed, may be desirable and imperative under certain circumstances to preserve and protect the public health, safety, and welfare, and, WHEREAS, the Council of the City of Tamarac deems mutual aid police service to be in the best interests of the community, and, • WHEREAS, the City of Tamarac desires to participate under a mutual aid police service plan with other local municipalities ac- cording to the terms and conditions hereinafter set forth, and, WHEREAS, authority is granted to enter into a mutual aid agreement as provided by law; NOW THEREFORE BE IT RESOLVED that the City Council of the City of.'Tamarac hereby approves and enters into this agreement, by which the Tamarac Police Department will participate with other member municipalities in a program of mutual aid police service, subject to the following terms and conditions: A-ut,hogization. RESOLUTION NO. 70 2. ? A Police officers who shall be commanded by their superior authority to maintain the peace or perform • r police duties. outside the territorial limits of the city or village which regularly employs such officers, shall be under the direction and authority of the commanding officer of MAI" to which they are called to perform police or peace duties, and shall be peace officers thereof: they shall have all powers and authority of peace officers as provided by law, including the power of arrest. 3. Mutual aid police service shall be readered faith- ` out charge to a member municipality; provided, however, that as a result of having furnished aid, should the assisting muni- pality be required to seek assistance from another non-member municipality, which imposes a charge for same, then in that event, the municipality originally seeking such aid a=' r:>- imburse the assisting municipality in an amount equal to 'hi: charge imposed upon the assisting =anicipali.ty by the w - pality assisting it. 4. Rl,ias and- RPRulations. The police chiefs of the palities shall establish -uniform rules and regula��:%�: ing and receiving aid, subject to the approval of the vo'V�y body of each member municipality. Liabil_3ty. All wage and disability payments, pension and work- men's compensation claims, damage to equipment and clothing, and medical expense shall be paid by the city or village reg- ularly employing -such peace officer. 6. ,I f� +;sre Este c,f Agreement. The clerk of each ri�a�sb�;r nunlci- pality shall furnish a certified copy of its resolution approv- ing mutual aid police service to each of the member xcunicipul- ities. Each resolution shall become effective as and between municipalities who exchange identical resolutions upon the data of such exchange. The adoption and Filing of the resolution shall constitute an agreement between all member municipalities for mutual aid police service. q. T rmi ation. The agreement evidenced by the filing of certi- fied copies of resolutions with the clerk of each municipality shall remain in full force and effect until such time as a municipality files with other member municipalities a certified' copy of•a resolution terminating this agreement, which date.of termination shall not be less than thirty (30) days after the date of such resolution with the clerk of each member manici- . pality.
