CITY OF TAMARAC, FLORI�7DA
RESOLUTION #�_L
WHEREAS, Behring Properties, Inc. a/k/a Behring
Corporation, as owner has offered to dedicate a certain
right-of-way for road purposes, and
WHEREAS, the aforesaid owner has agreed to enter
into an agreement providing that they shall be responsible
for the costs of construction of a road upon said right-of-
way when and if required, and
WHEREAS, the City Council is desirous of accepting
said road right-of-way.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL of
the City of Tamarac, Florida.
1. That the property described on the Deed attached
hereto, made a part hereof, and. upon the Certified Engineer's
Drawing, as attached hereto and made a part hereof is hereby
approved and accepted as road right-of-way in the City of
Tamarac.
2. That this Resolution shall be effective at the time
and upon +the date that the aforesaid owner provides an executed
Agreement in recordable form to the City indicating their re-
sponsibility for the cost of construction of a road and other
necessary improvements as required by ordinances at the time
of said construction, to the City.
3. That the City Clerk is hereby authorized to record
any and all of the aforesaid documents.

4. That the Mayor is hereby authorized to execute and
the City Clerk is hereby authorized to attest to any documen-
tation necessary to perfect the aforesaid intent.

1970.

South, Range 41 East, according to the plat of FLORIDA FRUIT LANDS
CO. SUBDIVISION NO. 2, as recorded in Plat Book 1, Page 102 of the
Public Records of Palm Beach County, Florida, lying within a line
53 feet, as measured at right angles to, the South line of said
Section 5; and that certain parcel of land lying Southeasterly of,
and outside of the arc of a circular curve having a radius of 25

THIS AGREEMENT entered into this 10th day of June,
1970, between BEHRING CORPORATION, hereinafter referred to as
BEHRING, and the CITY OF TAMARAC, hereinafter referred to as
CITY;
A
WHEREAS, BEHRING is dedicating certain rights -of -ways
to the CITY, said rights -of -way being more particularly described cn

in the attached Schedule A; and,

WHEREAS, the CITY will accept said rights -of -ways, it ..
is therefore mutually agreed as follows:
1. BEHRING will cause to be made all necessary paving
improvements to the rights -of -ways as described in attached
Schedule A.
2. Said paving shall be done when the lands surrounding
the rights -of -ways, as described in attached Schedule A, are platted
or otherwise developed, and it shall be the decision of BEHRING as
to when to commence the work as described in paragraph 1 above.
3. The work, as described in paragraph 1 above, shall
be done in accordance with the ordinances of the City of Tamarac,
and shall be subject to the approval and acceptance of the City of
Tamarac Engineer.
IN WITNESS WHEREOF, the parties hereto have affixed their
hands and seals to this Agreement.
