RESOLUTION # %(I
WHEREAS, the Department of Transportation has
made request upon the City to pass a Resolution and ex-
ecute agreements in connection with Project Number 86470-
6301 dealing with the Commercial Boulevard Interchange
and as to Project Number 86527-6601 dealing with the
Commercial Boulevard Overpass, and
WHEREAS, the City Council deems it necessary
and within the public interest to both encourage and
comply with the Department of Transportation's requests.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL
of the City of Tamarac, Florida,
1. That those Resolutions provided by the De-
partment of Transportation as to the above referenced
projects, are hereby,passed as attached hereto and made
a part hereof.
2. That pursuant to those Resolutions, the Mayor
and City Clerk are hereby authorized to execute those
agreements as to the above referenced projects, attached
hereto and made a part hereof.
3. That the City Clerk is hereby required to
hold the aforementioned Resolutions and agreements after
their execution, and not to release same until the follow-
ing have been provided and/or accomplished to the sat-
isfaction of the City Clerk:
A. An agreement with Behring Properties,
evidencing their agreement to cover the cost of or other-
wise bear the cost of or to reimburse the City for any
expenses incurred that would be a charge or cost to the
City in connection with the above referenced projects,
pertaining specifically to the cost of relocation of
drainage facilities in the area effected.

B. An agreement with Robert Trachsel and/or
his partners, corporations, or successors in interest,
indicating their intent and agreement to deed those lands
that they hold an interest in and necessary to the Depart-
ment of Transportation for right-of-ways for construction
of the above referred to projects. (This may be satisfied
by actual deed of the necessary properties.) (This agree-
ment and the contemplated deed the Council recognizes shall
be given by Trachsel in exchange for the Council's consid-
eration of certain rezoning or variance requests made by
Trachsel.)
C. A letter from the City Engineer indicating
that the City will not be exposed to any expenses in con-
nection with the aforementioned projects, that they will
not be reimbursed for.
D. Agreements with any and all private utili-
ties that may be effected by the aforementioned projects,
if such is deemed necessary, indicating the individual utili-
ties agreement to be responsible for the costs of moving or
relocating their utilities and that each will be responsible
to the City in the event that they should cause by an act
or omission an expense to the City in connection with these
projects.
