CITY OF TAMARAC, FLORIDA
RESOLUTION #
WHEREAS, the City Council has been advised by
that letter from Garden and Landscape, Inc., dated
September 25, 1970, attached hereto and made a part hereof
that Garden and Landscape, Inc., has terminated services to
the City in connection with that contract dated March 3, 1970,
and
WHEREAS, the City of Tamarac views previous actions
of Garden and Landscape, Inc., in regard to their obligations
as set forth in that contract dated March 3, 1970, as having
been violations thereof,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL of
the City of Tamarac, Florida,
That the City Council has no alternatives but to
consider such action on th*art of Garden and Landscape, Inc.,
as a material breech of their duties and obligations under the
terms of the Contract.
Therfore, the City Council instructs the City Attorney
and City Clerk to act in accordance with this finding and to
therefore not provide any payments from this date forward to
Garden and Landscape, Inc.
Further, that the City Attorney and City Clerk are
instructed to take whatever action is necessary inclusive of
Legal proceedings to enforce all rights that the City presently
or in the future may have in connection with the breech on the
part of Garden and Landscape, Inc. This is to include, but not
be limited to the prosecution and defense of any legal pro-
ceeding thereto.

The City Attorney and `the City Clerk are hereby
empowered to use every resource inclusive of employees, agents,
records, and documents necessary in order to affectuate the in-
tent of this resolution.
