HomeMy WebLinkAboutCity of Tamarac Resolution R-71-049CITY OF TAMARAC, FLORIDA RESOLUTION # 71 - 49 WHEREAS, by Resolution #71-43 of the City Council, the resignation of the firm of Deutsch, Deutsch, and Goldberg as City Attorney, Assistant City Attorney, and Prosecutor was accepted effective May 24, 1971, and WHEREAS, by Resolution #71-44 of the City Council, Richard A. Bird was appointed as acting City Attorney and acting City Prosecutor effective May 25, 1971, to serve at the pleasure of the City Council of the City of Tamarac, and WHEREAS, the City Council, granted such authority by the City Charter, is now desirous of relieving Richard A. Bird of the duties and functions of acting City Attorney and acting City Prosecutor, and WHEREAS, the City Council, granted such authority by the City Charter, is now desirous of appointing a City Attorney and setting compensation for same, and WHEREAS, Section #42 of the City Charter provides that the City Attorney may act as City Prosecutor upon request of the Clerk of Municipal Court, and WHEREAS, the City Council is desirous of setting com- pensation for the services of the City Prosecutor. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE City of Tamarac, Florida: 1. That Richard A. Bird is hereby relieved of the duties as acting City Attorney and acting City Prosecutor effective noon, June 243, 1971. 2. That Harvey Ford is hereby appointed City Attorney effective noon, June 24, 1971; provided however, that such appointment is contingent upon his acceptance of said appointment and stipulations of the City Council that his compensation will not exceed $35.00 per hour and he will not place himself in a position of possible conflict of interest by serving as counsel to the City and any other municipal civic organization at the same time. 3. Said appointment shall include representation in matters defined by Section #42 of the City Charter, including the functions of the City Prosecutor. 4. Compensation for services rendered as City Prosecutor shall be paid at the rate of $35.00 per hour, maximum. 5. Compensation for other services rendered shall be paid at the rate of $35.00 per hour, maximum. 6. Harvey Ford as City Attorney in accordance with the City Charter shall serve at the pleasure of the City Council of the City of Tamarac, Florida. Introduced by: Councilman Eugene W.
