RESOLUTION #7
WHEREAS, the City Charter of the City of Tamarac provides
that the City Prosecutor's functions may be the responsibility
of the City Attorney, and
WHEREAS, HARVEY FORD, Attorney at Law, has been appointed
to fill the Office of City Attorney by resolution, and
WHEREAS, said City Attorney has requested the appointment
of an Assistant City Attorney to serve as City Prosecutor and
to represent the City in the ad valorem tax suit brought by
the Tamarac Homeowners Association, Inc., et al. against the
City of Tamarac, and
WHEREAS, the City Council is desirous of appointing such
Assistant City Attorney and City Prosecutor and establishing
his compensation therefor.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF the
City of Tamarac, Florida.
1. That Mr. Fi, l"�Ap OC.I L_t_ . �o _ , an attorney
licensed to practice before the Courts of this State and a
resident of Broward County is hereby appointed Assistant City
Attorney to serve as City Prosecutor and to serve as special
counsel in the ad valorem tax suit brought by Tamarac Home-
owners Association, Inc. and others against the City of Tamarac.
2. That the compensation of said Assistant City Attorney
for his performance as City Prosecutor shall be the sum of
$ 50. C, v dollars per Court Session attended.
3. That should said Assistant City Attorney, in the
performance of his duties as City Prosecutor, be requested to
perform functions in addition to representation at Court Sessions,
additional compensation shall be paid to said attorney at the
rate of $35.00 per hour for time spent on the particular matter.
4. That such Assistant City Attorney shall receive
compensation at the rate of $35.00 per hour for time spent as
special counsel for the City on the suit described above.
5. Nothing herein shall inhibit the City Attorney from
acting as City Prosecutor when the City Prosecutor herein
named is, for any reason, unavailable.
6. This Resolution and the Appointment created hereby
shall be effective as of the seventh day of July, 1971.
